I am in this situation also. We sent everything on 8th September 2008 and nothing. We didn't file the EAD at the same time as I thought we would have the green card by the time my husband's EAD expires, which is 31st May 2009.

Since it seems it is now going to be longer, I sent the info on the EAD last week, but since I didn't have to pay for it, I didn't send a check that I can track, so I am at their mercy.

Our app is sitting at the National Benefits center also.

My husband did have a few arrests about 10 or 11 years ago for minor theft that I thought was going to be a problem, but he went through the K3 interview fine in England and it didn't seem to matter. We did answer truthfully on this application for the green card and send all the court docs and things like that. I honestly don't know if this is why it is holding it up, but why would they let him into the counrty in the first place then, if it is?

I don't know, I just really don't want for them to have lost it, but it seems that everyone that has an app at NBC has no interviews, so the chances of them loosing all of just ours would be remote, but you never know!

I plan on calling on my birthday, 13th March because then it will have been over 180 days, or asking for an appointment at the local place. I hope they send the EAD because for him not to be able to work would really suck.

Hello VJERS,

My aos was received by USCIS Sept 30, 2008. It was last touched on October 24, 2008 and it's been more than 3 months now and yet, it hasnt been touched and I havent received an interview letter yet. It was past 3 months already in the National Benefits Center (meaning it's past their timeframe) and I'm starting to worry.

Do you think I must have a service request for it? Or should I go for an info pass?

If anybody have the same situation, please contact me.

Thanks and God SPEED!

We are in the same situation here. Local office is Detroit, have not had a touch since our petition was received September 29th, 2008. My husband did get his EAD and AP in December. Still no interview letter.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

angelanddan, We went for our Infopass ( for another issue ) January 26th, and while we were there we did inquire about the interview letter and asked for information concerning our case. Those lazy folk who work there acted like we were asking them to perform a miracle. All we were told is that our case is at NBC and that they could not ( more like would not ) give us any information other than that. A total waste, and not the friendliest bunch.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Hi, My aos was received by USCIS october02 2008. I´ve got my AP and EAD in December, but I haven´t received the interview letter yet and the message on line is the same, is still at National Benefits Center. I am looking every day at my mailbox hoping to find the interview letter and finally end this stressful waiting. I have also realized that many october fillers have received their appointment letters...

I want to travel to my country to see my family, but I don´t dare to do it with the AP just in case I have problems to re-enter, so to get the GC soon it´s very important to me. SOmetimes I feel depressed about it.... Maybe at MSC they take a longer time to process the applications.

Let me now if you have any updates.

My husband IS going back home for a few months in March. He is going and there is nothing or no one that will stop him from leaving. I have explained to him the reasons why he needs to stick around, and he just can't wrap his head around it. He thinks he can re enter on his AP, but as you said, you are scared about the re entry and Im just terrified. We really thought we would have had the interview over with by mid March, but it's looking like that isnt going to happen. :crying:

I thought that I was going to have the interview in February or March too, but now I am desperate because is like everything is stopped. I don´t know when I will have the interview , I really miss my family and they are having a hard time without me too. I will wait to receive the green card, but If takes too long I think I will take the risk of the AP in 3 or 4 months. I would prefer not to do it but I want to be with my family at least during this year! I wish that the things were easier, I started with the visa fiancée application in december 2007 and more than one year later I am still suffering..

God luck to your husband in his travel! I must tell you that I have read that many people have traveled with the AP without problems, specially when there aren´t overstays.

I would call USCIS and ask them to do a service request. They'll do this if it's been more than 90 days since your NOA1.

I'm a July filer and received my EAD and AP in October (about a month after most people who applied around the same time I did), and I still don't have an interview date. My local office is also Detroit.

It's frustrating, I know. But you can call USCIS and make a service request. That's a lot faster than going for an Infopass appointment.

hello,

Hope u don't mind asking you some questions but before that wana tell u first how my papers go. So last january 27, 2009 we filed I-485 & I-765 or my change of status at chicago, my biometrics was done last feb 27th,09... after a month a recieve an RFE requiring us to submit my husbands recent 2008 1040s and w2s, employment letter indicating dates of employment, wages and salary, numbers of hours worked nature of the job since we only submit w2s 06,07 and an estimated numbers of 08 income tax return. My problem is my husbands job has a new policy of not giving out information of income anymore, so i decided to submit the 2007 employment letter it has everything there the same address, dates of employment , nature of the job,and hours he worked, except for the year they wrote that letter and the per hour of salary since he just had an increase. I also include my husbands recognition letter indicating of a job well done. Am confused i think thats way enough but let me know what u think

So i submit 1040,w2s 08, pay stubs, recognition letter dated feb 09, and a 2007 employment letter do u think this is enough????

thank u
