Adjustment of Status question

Timeline

My wife arrived here almost a year ago. I don't meet the income requirements, so last time my dad helped me. My wife got here 26 of march of 2008. My dad did in May. Now I don't have anybody else to co-sign for me. I should be getting a decent amount of money from my dad estate. I know that by then I probably could use this money to prove that I could support her. my question is. Can i somehow declare that estate as Income or asset ? thx for the help plp

Once the assets from the estate become your assets, of course you can show them on the I-864. They'll consider only those assets that could reasonably be liquidated for cash within 12 months. Then you'll need three bucks in assets for every dollar of income shortfall.

Once the assets from the estate become your assets, of course you can show them on the I-864. They'll consider only those assets that could reasonably be liquidated for cash within 12 months. Then you'll need three bucks in assets for every dollar of income shortfall.

Isn't it 5 to 1?

Example of How to Use Assets: If you are petitioning for aparent and the poverty line for your household size is $22,062and your current income is $18,062, the difference betweenyour current income and the poverty line is $4,000. In orderfor assets to help you qualify, the combination of your assets,plus the assets of any household member who is signing FormI-864A, plus any available assets of the sponsored immigant,would have to equal five times this difference (5 x $4,000). Inthis case, you would meet the income requirem

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

What if my husband made 100k, so for us the assets would need to be [(100k - 22k) X 5] approx 400k ?? that is a huge amount :crying:

Incase my husband lost his job would the assets need to be (22k x 5) = 110k?? :idea: In that case may be he is better finding 10/hr (or 12/hr) job so that yearly income would be 20k and the assets would need to be (22k - 20k) x 5 = 10k whch is within range of what we have what we have.

Also can the assets include 401k??

Let me know if my above guess is correct??? :innocent:

5 to 1 for other relatives but 3 to 1 for a spouse or fiance(e).

Generally a 401k would not be considered because it would not reasonably be liquidated within a year. It's possible, of course. Again, for a spouse the ratio is 3 to 1.

Wrong math!

If your husband makes 100K he is way above the poverty line of 22K. No assets needed at all!

If there is no income from a job or investments then you would need to show 3 X 22K = 66K. Though from reading other posts I think it is difficult to only show assets.
