Getting a Driver's License

Timeline

Today I took me and my wife (she entered the country on a K1 visa and we have filed our AOS paperwork) went to the California DMV to get her driver's permit.

My wife's K1 visa has an expiration date of July 30. Because of this, the lady at the DMV said that the driver's license would also have an expiration date of July 30. This is pretty useless! She said we needed to show some sort of documentation that the via had been "extended" for a longer period of time.

Has anybody had a similar situation happen? As I understand it, USCIS does not issue any documents that demonstrate an "extension" of the K1 visa after it has expired. What I am looking for is some document that shows that my wife is in the country legally after the K1 expires. Such a document does not seem to exist! Do we need to wait until she gets her green card before she can get a driver's license?

I would say your NOA's for AOS should be evidence enough. They show that you're applying for Adjustment of Status. Other document would be the EAD (if you applied for it). I would call the DMV and ask them what documents are considered by them.

When I got my PA State ID, they asked for my NOA's. And actually my ID was issued the day before my I-94 (and my K1) expired.

Call and ask them...
