Hello,

I am planning on going to the US with my recently obtained K1 visa on feb. 13th. We'll get married (legal wedding) asap and apply for AOS, EAD and AP.

We're planning to be back in France for our religious wedding at the end of August and my question is the following:

If we file in february, do I risk getting my AOS interview scheduled while I'm abroad (possibly july-august) ?

Or will they take my time outside of the US in consideration?

If anyone's gone through that in the past, please let me know how it went: I can't find the answer anywhere here.

Hi Sophie,

If you file for your AOS asap like you said in febuary, I think you should be all right.

First of all, when you file, you file also for your AP; and in general, it is the first paper who got approved. I received my AP in 2/3 months I believe.

So in your case, it means you would receive yours in april, or even if it is june, you're still ok with your trip!

If your AOS is still pending, it is the paper you will need to go through immigration.

Secondly, you may have an interview, but you also may not have one.Most of the K1 have their case transfered to CSC, and generally, you get approved without any interview. At the same time, it doesn't apply to everybody, it depends of your case and the person seeing your case.

All of that to tell you that you should not worry too much! I just got my AOS approved in 4 months!! :)

If you want to be careful, I would travel in August, to give yourself an extra month.
