Ok,

So its Tax Time....

My fiance and daughter just got here in January. We will marry mid/late February.

My Question is:

Should I claim my daughter this year AND does the support I provided to both of them while they were still in the Philippines(+/- $500 a month) make any difference? In other words, is it worth mentioning at all?

Sorry, all this is new to me.

If you marry in Febuary you will be able to claim them as dependants and file jointly on your 2009 taxes but not your 2008 taxes. You cant claim the 500 and you wont be able to claim your daughter as a dependant because she did not reside with you in 2008.

It discusses who is your dependent. For the most part, it is blood relatives. If it's your fiance and her child, you don't have a spouse or step-parent relationship until you marry in 2009.

Read the rules to make sure.

IIRC, you are entitled to claim a deduction for minor children you support if they are considered a member of your household. explore it from that angle.

500$ a month? that's a lot of cash in PI. you are marrying a woman who doesn't have a job?

IIRC, you are entitled to claim a deduction for minor children you support if they are considered a member of your household. explore it from that angle.

However, they must be considered a resident alien for tax purposes.... Unless they are able to pass the "greencard" or "substantial presence" test you will be hard pressed to claim them.
