I have a question about the requirements for filing a W7 Individual Tax Identification Number. Says that photocopies need to be notarized by either A) A US notary public, and B) a foreign notary public (with some conditions that need to be fulfilled).

According to the W7 instructions, there is a US notary public available in the embassies worldwide. I am looking to have photocopies of my passport photocopied. Can I do this at the US Embassy in Manila?

Hoping for any input on this. Hubby is looking to file his returns at the soonest possible time and it takes about 4-6 weeks to get the ITIN.

I had her FedEx her Philippine passport to me and I took it and the W-7 to the local IRS office got it done in a snap.

Did they give you your wife's ITIN when you went into the IRS office? What things did you need to take with you? I assume now you can file your taxes electronically? Thanks :thumbs:

Yeah they will issue it there at the IRS service center. As long as you have the passport you dont need anything else. The instrustions for the W-7 tell you what documents to bring if you dont have her passport and they tell you how to file in person.

I cant Efile because I'm self employed and I've got a complicated return but I assume others could.

I brought my husband's passsport with me after a visit because I knew I would be returning before he needed it. I took the tax forms signed by both of us, the W-7 signed by Manuel and the statement to be treated as a resident for tax purposes signed by both of us to the local IRS office. I also brought ourmarriage certificate and his birth certificate just in case. The lady took the papers and made copies of whatever she needed. She stamped our tax forms received date and I left. They do not issue a number at the local office. The forms are sent to Austin and Austin sends the ITIN number. Your return also gets processed somewhere. I received the ITIN number about a month after I filed and the refund came in less than two months after I filed the papers at the IRS office.

Really, in 2005 it worked ...sorry if I am mistaken. Did they give you a copy of the stamped forms that you could use as proof you had filed?

Yes, they gave me copy of the W-7 and 1040 pages 1 & 2. I didn't need copies of the others, because I already had them. There is an original stamp on the W-7 and the page 1 of the 1040. I believe the orginal stamp would be the key. It would be better than just a copy you made with no IRS stamps if the transcripts are unavailable. They never asked me about additional tax returns at my interview, they were more concerned about visa fraud.

On a side note, I got my last 3 years tax transcripts at my local office in about 2 minutes. No worries about your sensitive info going through the mail. They don't look exactly like the ones they send in the mail, but they were stamped just like my tax return.
