I've just discovered a worrisome issue regarding my birth certificate and my mother's birthplace.

In the I-130 petitiion, I entered "Santa Maria" as my mother's place of birth since this was the information my father gave me. He was citing her NSO-certified BC.

Eventually I got copies of my NSO BC as well, but found out that her birthplace indicated there is Manila.

She now says her correct birthplace is indeed Manila, as far as she can remember her parents telling her. There's also an issue with her own BC: one she found decades ago at her hometown had the correct birthplace (Manila) but wrong first name. The one at NSO has the correct name, but wrong birthplace (Santa Maria).

Now what do I do about this? Do I enter "Manila" now as her birthplace in my DS-230? Wouldn't that make it inconsistent with our I-130 petition? Or do I stick to "Santa Maria" citing her NSO BC, and citing possible clerical error in my own BC? I don't know what to do about this. I have no idea how long it's going to take if they ask my mother to amend her NSO BC (to show Manila). And even then, wouldn't that invalidate our I-130 petition??

Check with your local NSO office and see if you can get a "affidavit of descrepancy".

WHAT I DID WITH MINE IS GOT A STATEMENTS FROM RELATIVES, WENT TO COURT, PAY THE FEE, ADJUSTED MY BC CAUSE IN MY VISA ITS STATES MY LAST NAME SPELL WITH S, WHICH IS THE ONE I USED ALL THE TIME, BUT BC SPELLED IT WITH Z, SO I HAVE TO CHANGED IT FOR THE INTERVIEW..

Thank you. But according to my mother, there's no mistake in my BC. It's in hers. And because I went by the info given me by my dad at the time, it's also what's in my G-325a.

Now I worry that if I put the correct birthplace in the DS-230, it might invalidate the (-130 petition, or otherwise cause a delay instead of making it better. I don't know what to do.

Since it's moms have her do it. At the same time MANY of older peoples BCs in the Philippines have mistakes. I wouldn't be to concerned.

Thank you. That's reassuring. I'm just undecided whether or not to make the DS-230 same as G-325a or make the correction there.

Go with your BC, that's a legal documents... then get an Notorized statements from people that know about your paperwork.

You may hit a few hiccups later on if something doesnt match, spend few dlrs or pesos to get a notorized affidavit that what need to be corrected.

When my last name in BC was spelled "Z" but I used "S" throughout my entire life, they wont give me my VISA till it was corrected. I have a Notorized form stated that my name was indeed with "S", took it to the court, pay the fees and gave me my BC with the correction attached to it. I went to embassy with it and got my VISA.

I'm not in the Philippines right now. We're living as expats in Thailand. I don't know if I can go to the Local Civil Registrar or NSO to get my BC corrected.

On the other hand, it seems more complicated and troublesome to have my mom amend hers. I wish I knew what to do.

from what i understand,as long as you dont have error(s) on your BC you're fine.no need to correct your mother's BC since they wont look at it and she's not the beneficiary.i made a mistake too when i filled out my G325A but got no RFE and the consul didnt question me about it.

on the other hand,if you have a mispelled name,that'll be the time that you need to have it corrected per RA9048

Maybe we should call the NVC and ask what their advice is?

About how long from the date of NOA2 should we start calling NVC to check if they have our case?

We received our approval email on a Wednesday a.m. and NVC had the case number the following Monday.
