Hey guys!

I am an Australian and moved here in 2006 to be with my husband. Well, it turns out that I am the one supporting him as he can not hold a job, and he also suffers from addiction to prescription medication.

I was wondering how I go about leaving the US? Can I just leave or is there a procedure that I have to go through? I really want to go home :(

October 5th-Recieved NOA for AOS & EAD

October 9th-Recieved biometrics app letter

October 22nd-Biometrics app

November 5th-Recieved RFE

November 22nd-Sent evidence

November 27th-Touched-Case resumed

November 30th-Touched

December 17th-Transferred to CSC

January 7th 2008-EAD card ordered

January 16th-EAD card in my hot little hand!

January 22nd-Green card ordered!!!!!

Well , you could leave anytime and there is no procedure for it.

but if u want to make clear and have fresh start in Australia, Better Get the divorced 1st then leave.

Depending on your state of residence, it would be wise to visit a domestic relations lawyer to get the divorce proceedings started. Then you are free to return home.

On the other hand, you could return home via the next flight and not even think about the divorce, hoping he would be the one to file. In general, it would be based on abandonment, and you would be the guilty party.

In general, you can expect to fork over as much as $2,000 up front to get the lawyer started.

You can do anything you want as long as you have a passport and the money to buy a ticket. Leaving doesn't dissolve the marriage. At some point you'll need to decide and act on that or be acted upon.

I agree...just leave

It's easy to just leave, but it is stupid. There are certain rights and obligations to being married. One is that the spouse can seek support and inherit property. Imagine if your husband does not seek a divorce and you want to marry someone else back home. That's bigamy. If he wants some of your earnings, he can go after it. Get the divorce.

Your husband can get a judgment from a US court and seek to enforce it in Australia. People may not do it for other countries where the judiciary is corrupt or powerless. Australia will likely, due to judicial treaties, enforce a US judgment where you are a absent party.

P.S. Debt during a marriage is joint debt. Both parties are responsible for all (not just your half). So if you leave, your husband can run up debts after you leave that you will be responsible for. Get the divorce.

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

I agree. You are free to do as you please.

Keep in mind the whole divorce proceedings thing. I know someone who is doing the LD divorce thing and it is not pretty.

This is my personal view. I also have to return to India and we have mutually discussed & agreed on this as I dnt feel good here in usa in regards to human interaction & society. Anyways once I leave she will file for a dissolument/divorce based on abandonement. Its cheap and quick. If your spouse agree on that, it can be done. BUt it can never be done, unless & until you dnt leave usa. Thanks.
