Hi everyone,

I am really confused. Please help.

Me and my husband went for GC interview yesterday. We also brought our 18 month old son with us. Everything was going smooth. Officer called us in the room. She ask us few questions about how we met, ask about my past visas. I enter as J1 then change to B2, then was trying to get F1, but was denied. So I overstayed about 5 years now. Then she looked through photo album, went to make a copies of some supportive evidence ( bills, bank statements.etc.). When she came back she told me: "Congratulation, you will receive your Green Card in 10 days" Then she ask me questions from I -485 Part 3 form, and gave me an envelope, in which I should send my I-765 back. She show us our way out and congrat us 1 more time.

Well, today I received a notice to appear for the second Interview and submit additional evidence, including I-601 Waiver of Inadmissibility because of fraud or misrepresentation. :o

I am so frustrated now :( Was that just a mistake?

Does anyone else being in situation like this?

I am sorry but this could be serious... do not take this lightly.... it appears that you have been scheduled for a Stokes Interview... read and learn all you can about this

When was the last time you re-entered the USA and on what status

Since you were not asked about your relationship all that much and the officer congratulated you in the end, I doubt it is related to the authenticity of your relationship. Sounds like a technical mistake on your behalf. Did you disclose everything correctly on the submitted forms???? And don't go to your second interview without a lawyer

hmmmm.... IMHO there must be some mistake along the lines...

the timing is totally wrong....

even if she typed the letter yesterday it is not likely you would receive it today..

anyway, as other people suggested, consult a lawyer..

hmmmm.... IMHO there must be some mistake along the lines...

I agree with Maad, but definitely contact a lawyer. I think it is physically impossible for the letter to have something to do with the interview. Unless they sent it overnight. But still, call an attorney ASAP.

There is a note on the letter: HAND DELIVERED

I sill cant belive it, why would she change her mind??

I made an appointment with Info pass for Monday. Going there to find out if that was a mistake. Hopefully someone there can check it out.

We had to rescheduled INFOPASS for thursday 7:30am. I will let you all know right after. Me and my husband are also wrighting a letter to immigration officer, who was interviewing us.

Sorry you are going through this. What is the additional evidence that they are looking for?

They want me to file I-601 Waiver Inadmissibility. Here what i read in the letter:

1.You are required to provide a typed, signed and sworn notarized statement from ball squalifying relatives as defined by this section of law, documenting in full detail what serious and/or extreme hardship that he/she would endure if you had to leave the United States. Note that extreme hardship is more than just a mere separation or a financial concern.

2. Copies of all pages in passport used to enter US and I-94 record

3.Refer to page 6 and 7 of instruction to Form I-601 for additional evidence

4.Sworn statement detailing the circumstances su\rrounding the entry. To be taken by USCIS officer

5. You must file I-601, sign and pay fee ( fee is around $600!!!)

Hi. Was your AOS based on Hardship at all?

And mailing in your EAD (I-765), i have not heard of that before. they normally just take it if you are approved.

And yes that seems waaaay too fast for them to send you letter like that, i mean come on this is UCSIS we are talking about.

Do you have a criminal record? Have you violated your immigrations status in the past? You should have some idea what the problem might be.

I have no criminal records, and i didn't violate immigration law. The only thing is I was in US without status for around 4 years. I know many people who got there GC after being here without status. I have no idea why it is happenning.
