Hello,

I haven't posted here in a while.My green card will expire in april and need to submit my I-751 soon.My dear husband owned the house before our marriage and all of our bills were under his name and we didn't really know that something like this would be needed like submitting joint mortgage/lease and if we will do it like adding my name to the mortgage it would require refinancing which is a big no for him anyway.So guys,anyone here who got approved without it?I want to avoid RFE.Would appreciate any inputs.thanks.

We have the following...

-joint taxes

-joint health insurance

-joint car insurance

-401k showing me as the beneficiary

-letters/cards

-photos

I have yet to see an I-751 denied for that.

They look at the total of the evidence sent to them, and if they think it is weak, they will schedule an interview.

AOS (I-485) is different than Removal of consitions (I-751). I-485 does not require any relationship evidence other than a copy of a marriage cert. Removal of conditions is testing to see if the 2 year green-card CONDITIONS have been met "Still in a bonafide marriage" OR entry to the marriage was in good faith.

As our AOS was on K-3 after living in the USA together for over a year, the interviewer wanted to see proof that we had been living as husband and wife. Based on the circumstances (and the fact that it was for a 10 yr GC) I believe it would be similar.

We were in a very similar situation to yours. House was purchased by the USC long before we met, and utilities were in USC's name. We never bothered to change it. We had no trouble being approved without joint mortgage/lease/utilities. But we had a child together, and had a joint checking account, joint taxes, joint insurance, joint titles on our cars, and a number of other areas of evidence. As has been said, they look at the big picture. Not everyone will have each type of evidence, and it's generally ok to have one area lacking if the pile of evidence taken as a whole points solidly toward a bona fide relationship.

04 Apr, 2004: Got married

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

We only have two bills in joint name and then our checking account. I had several friends and family members write affidavits about our relationship. It seemed to work, Claudeth was approved in five months.

I'm curious for when we file our I-751 if you had the affidavits notorized? I have two cousins who work for DHS that will write the affidavits for us.

A friend was called in on this, brought in a letter from his bank stating to add his immigrant wife, would have to refinance his home at higher rates with extra closing costs, also brought in copies of WI divorce state statues where his wife could get half of it. He was really upset with the USCIS, but they let it go through.

How many times do you get different results with different IO's.

Besides wanting to share my life with my wife, also wanted to share my possessions, she really didn't want my home in her name as well. My obstacle was finding the form, darn attorneys want 500-1000 bucks to tack on a name. But did find the form, also had to do a state IRS thing, typed my old deed exactly, got help from our register of deeds on that crazy IRS form, no taxes were involved, but don't speak IRS. So for ten bucks, it was done and legal. My home is paid off. But can you believe after that, they still wanted to see a utility bill? Dealing with a bunch of paranoid nuts.

My AOS was approved without it and even without an interview. I don't think that should be a problem when we file for removal of conditions. Daniel bought the house 3 years before we got married and doesn't make sense to add me now and pay a lot more. Same for the car we bought for me, we realised that if I was put on it they were charging a much higher interest so there was no point. We have tonnes of other proof and in the next year or so will have even more.
