She does not need another medical exam because the one she had done is good for one full year, that's why she won't need a new one here in the US for AOS unless the USCIS misplaces it. Argue this issue with the embassy if they keep telling you that she needs to have another one done.

Diana, They are trying to say that the medical has to actually still be valid when she enters the U.S. at the time of POE. Her medical stuff expires this April and she is not planning to come until June, as the visa is stamped valid until July 13th. I don't get it- so if she just came in June as planned- if she never opened the sealed packet- they may not have let her in because the medical is more than 1 year old and technically expired? I am trying to get thru now, but all lines busy so far...

11/13/2008 - I-129F NOA1 issue date

11/17/2008 - Received NOA1 hard copy in the mail

1/23/2009 - Received email stating I was approved (NOA2) on 1/22/2009

1/26/2009 - Recieved NOA2 hard copy in the mail

4/29/2009 - Embassy interview date - was put into AP (given a form with 221(g) box checked)

12/25/2009 - Still stuck in AP- almost 8 MONTHS and counting... :(

12/28/2009 - Embassy finally called my gal for another "interview"

1/14/2010 - VISA APPROVED at the second interview- took about 8 1/2 months of AP

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

12/16/2010 - Sent in packet by Fed Ex to Chicago

1/7/2011 - Notified by email from USCIS packet was received

1/25/2011 - Notified by email we are receiving an RFE

2/4/2011 - Sent translated birth cert in (RFE)

It is so frustrating. I was never able to get thru to the embassy today on the phone. But, below is the email reply I got from the embassy when asking why we would have to get the medical re-done:

Medical exams are valid for only one year from the date they were originally done, and they must be valid when the visa holder enters the United States.  Even if the visa was valid until July, if the medical exams expired before their entrance to the United States, your fiancée and her son would have serious issues when they arrived at the port of entry – they might very well not be permitted to enter the country.

The DAS and medicals are different.  The DAS certificate only has to be valid at the time of visa issuance.  The medicals must be valid at the time the applicant enters the United States.  For that reason, we normally limit the validity of the visa to the validity of the medical exams.

I don't know what to do, but if they make me do this, what choice do I have? I guess they hold the power to do anything? I wonder if medical really does need to be valid when entering U.S. on a K1 visa? HELP!!!!

I feel really bad for you. You have been through sooo much and now this. I don't have an answer for you, but if I were you then I would tell your fiancee to get a new exam. You have plenty of time for a new exam and you don't want to prolong this anymore. It would be a real disappointment for her to be denied at POE.

I feel really bad for you. You have been through sooo much and now this. I don't have an answer for you, but if I were you then I would tell your fiancee to get a new exam. You have plenty of time for a new exam and you don't want to prolong this anymore. It would be a real disappointment for her to be denied at POE.

I'm guessing that is going to have to happen. They embassy has all her documents right now, so we have to figure out how to get all that stuff back into her hands. She called the doctor's office today (Gonzales) and they need her passport and an "appointment" letter, and who knows what other paperwork, to do it again. I'm sure that won't go off without a hitch of some sort. This whole thing is like a bad movie- you must read half the ###### I post and just shake your head....

Sorry to hear about all you hassels. Just wondering if we do not receive our appointment letter for interview we can not get medical? What do we do

It is not necessary you wait for the letter of the embassy, you can download it from the website, just check when they update the page list of scheduled appointments. The file is large, only print the sheet where your case BGT appears.

Hey Joe I'm truly sorry about your problem. I hope you get to fix it soon.

Well as most of you know we have our interview on march 16 but I have a few questions...

I've heard from other people that there is a package that you have to mail to the embassy before the interview. What is this about? All I have gotten so far is an interview letter through the e-mail from the NVC and in this letter they just tell me the date of the interview and that all my documents are ok. So I have received no further instructions and am a little worried 'cause I want to start getting things ready and don't know where to start. We're filing for a CR-1, if that makes any difference.

Also, I think I read somewhere that you have to bring all the documents you have submitted before to the interview. Does that mean I have to get new police, marriage and birth certificates? Even a new signed copy of the affidavit of support?

Another question I have is:

I went ahead and took the lab tests yesterday and set an appointment with the doctor (Gonzales) for Feb.23rd (earliest available) but during the lab tests they didn't give me a drug test, which I thought they would along with HIV, since I had read about them somewhere. HIV I understand they no longer do. So I'm thinking the doctor will give me the drug test? I don't do drugs or even drink very much at all but I usually drink a lot of water and have heard that this can cause a drug test to be invalid. Do I have to avoid drinking a lot of water during the days previous to my physical exam? They weren't able to give me any decent information at the doctor's office so I thought you guys may know. Maybe there isn't even a drug test or maybe it's included with the serology.

Any help will be greatly appreciated!

This still doesn't make sense to me. Let's say that she needs a valid medical exam at POE, that still doesn't explain 1. why her visa is valid until July if her medical expires in April, and 2. what if she had planned to fly out next week? that's still weeks before April, so they won't let her fly out then either?

Unfortunately, you're at their mercy and if they choose to make her to get another medical even if she wants to fly in March, then that's what she will need to do. But this is the perfect example of bad administration.

Since you filed for a CR1 visa you won't have to take any documentation to the embassy since you already sent it to the NVC for them to process. hello everyone today i found out Sandra and i have our interview on the 9th of march. now we have a lot to do we have so schedule medical and we have to pay visa airline and apartment i am getting nervous now
