Just going over that form and filling out first 2 pages as part of short cut to fax next week to get interview date... Questions I have is:

On question #25 (last question on page 2) asks to list all previous visits she had to U.S. Will they be strict as far as comparing what she writes and to what the DAS Migratorio report actually states? She doesn't have that report yet, but I'd like to use short cut and fax in a couple days- long before she gets that report. Also, she used to (up until recently) have a tourist visa, so her trips to U.S. have been quite numerous over the last 5 years...

THANKS for any help, and more questions to follow..............

Joe,

She needs to be honest on all her paperwork, so if she was here in the US, she needs to write that information down regardless of what her Carta Migratoria may show.

Also, if you're sure the embassy has received her case from the NVC, fax and mail packet 3 ASAP so she can get a March interview. Don't wait for packet 3 to arrive because chances are, it may never show up.

11/11/2008 - I-129F Sent

11/13/2008 - I-129F NOA1 issue date

11/17/2008 - Received NOA1 hard copy in the mail

1/23/2009 - Received email stating I was approved (NOA2) on 1/22/2009

1/26/2009 - Recieved NOA2 hard copy in the mail

4/29/2009 - Embassy interview date - was put into AP (given a form with 221(g) box checked)

12/25/2009 - Still stuck in AP- almost 8 MONTHS and counting... :(

12/28/2009 - Embassy finally called my gal for another "interview"

1/14/2010 - VISA APPROVED at the second interview- took about 8 1/2 months of AP

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

12/16/2010 - Sent in packet by Fed Ex to Chicago

1/7/2011 - Notified by email from USCIS packet was received

1/25/2011 - Notified by email we are receiving an RFE

2/4/2011 - Sent translated birth cert in (RFE)

They don't seem to care what the carta says, it's just supplementary evidence and they seem to know it's quite likely to be riddled with errors. I told them by e-mail a couple of weeks ago that ours was wrong and asked if it would cause a problem and they blatantly said it won't be an issue.

Because it's a typical Colombian answer. It should be such an important document that should show every trip on it and they just shrug it off.

I have another question about using the shortcut below of faxing Packet 3:

After confirming that the embassy has your package follow these steps. You do NOT need to wait until you receive package 3.

Prepare your package 3 response. It should include the following items only. There should be a total of 5 pages including your one page cover letter.

1. Cover letter

2. DS-2100 (page 4 of packet 3 instructions)

3. DS-230 Part 1 (pages 1 & 2 only)

4. Copy of fiancée's passport (biographical data page)

In my case, my fiance has a son and I understand that we have to fill out a DS-230 form (pages 1 and 2) for her and also him, but just one of the DS-2100 forms will cover both. My question is should I also include a copy of his passport, along with hers? I also plan on mentioning his name on the cover letter...

I have tried to post my embassy review...Capt. Ewok told me to logout and back in and if not try another browser(Firefox). I had already done all of those things...but when i go to post my review it says I need to register first....lol. :protest:

You are correct, one DS230 per aplicant which in this case are your fiancée and her son, and one DS2100 for petitioner, in this case you, and the passport copy is per applicant

You are correct, one DS230 per aplicant which in this case are your fiancée and her son, and one DS2100 for petitioner, in this case you, and the passport copy is per applicant

The DS-2100 is not about the petitioner but it's all infor about the beneficiary, or beneficiaries in your case, telling the US embassy that they have ALL documents they told them to get before the interview. Only 1 DS-2100 is needed since your fiancée and her son are related. This is what the DS-2100 instructions say:

FORM DS-2100

NOTIFICATION OF APPLICANT READINESS

You, or your agent, may notify United States Embassy Bogotá that you are ready for an interview by using this Form DS-2100. The form indicates that you and your family members (if applicable) have obtained all the necessary documents for the immigrant or K visa interview.

What do you mean by typical Colombian answer? That was a USA government answer, and it is very serious

It may come from the embassy but the people checking this documents before the interview are Colombian, the people answering the e-mails are Colombian, the people answering phone calls are Colombian. The COs, which are the US citizens working at the embassy are the ones who conduct the interviews after all paperwork has been checked by the other people, who are Colombian. So yes, to me it's a typical Colombian answer and yes, it should be very serious thus the sarcasm in my answer. These things are serious and so are the documents and yet they shrugged it off.
