felo391971,

I wish the US Embassy in Bogotá would make a decision and stick to it. A few years ago the Instructions Package said that the baptismal certificate was a requirement to get the visa, then they changed it to say it was only needed if it was available, I just checked the instructions again and they changed it back to say that it is needed.

Anyway, a few years back people who didn't have it had to get a document called "Declaración Juramentada" (affidavit) that said the beneficiary was never baptized in the Catholic church and that a baptismal certificate was not available. To get this affidavit, the beneficiary has to go to a notary with two relatives as witnesses so they can sign the document. They also need to bring their cédulas with them. If the person was indeed baptized in a Catholic church, a baptismal certificate will be available and an affidavit won't be necessary. Post #83 of this thread has more information about the affidavit.

The reason why the embassy is making this a requirement is very simple, 95% of Colombians are Catholic and many baptize their children before registering their births with the government; therefore, a baptismal certificate in many cases can act as a back up for the birth certificate. Also, many people get married in the Catholic church but never get a divorce thinking it was not legally binding. This is incorrect because most religious marriages in Colombia are registered with a notary to make them legal. So if someone is requesting a visa their baptismal certificate's information needs to match the information the applicants put down in their application.

As for getting an interview faster, there is nothing you can do because the US Embassy is the one who has to let the NVC know when they'll have room for more interviews. The NVC is just waiting for the green light from them.

Can Anyone answer this Question?

My wife from Colombia, had her interview last year for the K-1 on Oct 7, 2010, and and Recieved her K-1 Visa dated Oct 12th 2010. Traveled to the US, on dec 2 2010, and we were married 5 days later.. She recieved her Advance Parole (AP), several weeks ago and is traveling to Colombia this week using her AP.

Her daughter was listed on the K1/K2 and designated as "will follow"... We were told, by the Embassy, we have a year in which we could submit the needed documents to have her daughter here..

So the question is, we're ready to start the process. What do we need to do.. So we simply send the Appointment package to the Embassy? Or do we need to do something more?

Please let us know if anyone has any experience with this. We want also to know, when is the year up? Is it one year from the Interview? or from the Date on the K1 Visa? Then, once she recieves the Visa, how long does she have before she's reuired to enter the US, because, I am guessing that we need to do this prior to Oct 7, 2011 since that will be one year from our Interview date, but her mom and her daughter want to spend christmas in Colombia before her daughter comes her to the US and begin to settle in while waitin to AOS for the daughter...

Also, when do we need to show the fathers permission? We have a verbal Promise from the father that he will allow his daughter to come live in the US with Mom, so do we need the permission at the Interview? or is it only needed when she is ready to leave Colombia...

Many questions, please help...

Thanks

Kenny,

The part about the verbal permission from the Father - Leidys believes that Maritza will need to sit down with the Father of their child at a Notary office and have the paperwork signed in the presence of the Notary in order that everything will be considered legal. Sofia had to proceed without the help of the Father, and with legal assistance, was able to have everything wrapped up without any problems. As you know, Dereck and Sofia took Sofi's daughter to Colombia without any problems using her Green card. If I were you, I would definitely give Sofia a call. She is one of my friends from the Colombia Club II. You can email her, or contact her via Facebook and ask her what she did. Leidys leaves for Barranquilla on June 15th, btw...

I would call the USCIS first to see what they say because the only option on the form that may apply is Question 2, Section B, option D: My existing card has incorrect data because of USCIS error., but... not really because you're saying it was their mistake when in fact it was yours to begin with. It's obvious the person who interviewed you didn't do anything to make the change or the USCIS didn't process the correction he supposedly made. You still should call them to see what they say, but without proof, you may have to pay to have it changed.

Now, since they don't have a specific option on the form to say you want to change the birth date, it may not matter at all. If it were me, I would personally like to know how big of a deal it is since the birth date doesn't match the date on the passport but other people, including immigration officials may not see it that way.

No, that's pretty much it. If you have copies of what you sent to the NVC, take them with you to the embassy for the interview just in case they say they're missing a document. Also, take evidence of your relationship with you in case they say what you already sent is not enough or in case they misplace it.

I just wanted to tell fellow Colombian filers that we sent our packet in at the end of January and this morning we found out we just got our NOA2!!!!

Now it's trying to organize the next step and get everything together. I've seen some "how to's" buried in this thread so I'll have to locate them to make sure I have everything.

For those just starting the process or in the middle of it, stay strong!! Yours will come soon and it'll be the most amazing feeling in the world!!!!!!!!!!! I'm in shock right now. It's almost unbelievable, like a dream. It's amazing!!

Thank you so much Diana! Your prior posts have helped me in the past! Old posts are presents that keep on giving through the generations!

Basically the next steps come down to these steps if I'm not mistaken:

  • Application is sent to NVC
  • Wait about 3-5 days to start calling NVC to learn your case number and when they will send it
  • Once you get the date that they will send it, start calling the embassy 3 days after that supposed date to find out if the embassy has gotten it
  • Once they have gotten it, send in packet three via e-mail (you don't have to wait for it to get sent)
  • Once they get packet three, keep checking to see when your interview date is
  • Start preparing the other things

And for packet three you need to send via e-mail:

  • DS-2100
  • DS-230
  • Cover letter

And that's it in a nutshell to get your interview date?
