have not been around here for a while, just in the ending stages of removing conditions. If any of you have any questions feel free to drop me a line. Great to know that in the big picture all the waiting we do isnt all to bad. I know easy for me to say as im close to being done with everything. Once you get your significant other here everything seems to move a lot easier. good luck to all

Timeline
Visa denied 221g requesting some information regarding her visit to the u.s. on a student visa. Looks like Im looking at a possible visa denial we have a second interview on thursday and we have the info in route. We had to buy a pin and reschedule the interview. She told me give her the info we will take a look at it , but her getting married so quickly looks very bad .....we might be talking about inadmissibility. I am worried but theres nothing I can do at this point Im praying for a possible approval but the likelihood of getting a approval is slim. Joe take care and uhhh alberto said it was you martha is his sister who is married to a canadien. Take it easy

Aughhhh that sucks!! Hopefully things will turn out better on Thursday when you go back to show them what they want to see. Think positive, negative thought are not needed now.

P.S. I don't know if I was at Alberto's apt., or his sister Martha's!!! It was a 3 bedroom close to a mall, I remember....

Yep, that's the same apartment. Alberto owns it but his sister Martha and her husband are the ones who help him with the transaction since he doesn't speak any English. He's a very nice and honest guy.

Oh no Pat sorry to heard that. I had a student visa before so what kind of information the embassy asked her for?. l need to be ready for these thing about my student visa. wow!. I wish you guys are doing good for the next appoiment, l will see you will be aproved!!!

That's right. Love happens as much as Sh!t in this life; and returning to Colombia would be a fairly good indication that there was no initial intention to stay from the git-go on the Student Visa. Never mind a couple of facts:

Student Visas (F-1) used to be subject to Adjustment of Status. I have personal experience in this. Not sure if they are anymore though.

Nevertheless, the intent of the Student status has little to do with the visa approval process on YOUR process.

My suggestion would be to include student study records (grades) along with the interview. Doing well enough in the courses your SO was in during this time that led to the original abandon of the US once the student status was up should be able to help. Furthermore, if you are also present for the second interview, you definitely don't want to get 'smart' with the CO about what is and what isn't allowable for AOS due to a petition process... BUT... you can kindly remind them of such without any quarrel over who knows immigration procedure better. Clearly they are State Dept and are more burdened with trying to weed out the visa fraudsters... so perhaps part of that evidence you take back to the Embassy should reflect that a return to Colombia was always in the works... for example... the return airline ticket being used reasonably on or about the original date of return within the limits of the Student Visa expiry.

Suerte!! Its all about not acting 'guilty' in their eyes but rather... that you would rather have sponsored your SO's visa instead of trying to fast-track an AOS already stateside if available.

I am sorry to hear about the 221g- I hope that they will approve it when you show them the documents they are asking for... you have another interview this Thur.? Keep us informed and good luck- I hope you get an approval...

Yes it is on thursday . I consulted with an attorney and he said that it was a bunch of bs that what happened there is they thought we were lying to them .when we show them the documents and explain our story there should be no reason for them to deny in fact he said if they deny and return the petition and apply for an appeal I290b we have a very good case . All I can hope is for the best best of luck to you joe good luck .......

12/28/2009 - Embassy finally called my gal for another "interview"

1/14/2010 - VISA APPROVED at the second interview- took about 8 1/2 months of AP

1/21/2010 - Visa delivered by courier- BUT, she opened sealed envelope that was for U.S. Immigration at POE.

Now embassy in Bogota wants us to do the medicals all over again.... nightmare continues.....

2/22/2010 - She went back to Bogota to get labs and medical re-done. Then back to embassy where they finally

re-issued the visa. Is valid until July 13th

7/3/2010 - She made it to the U.S. finally!!! I filed on November 11th 2008 and went thru 8 1/2 months of AP

1/7/2011 - Notified by email from USCIS packet was received

And I hear both of you her visa was approved .........OMG I couldnt believe it. We didnt even have an interview. expect to wait a long time when they call you back 221gs took forever there were abput 4 or 5 of us left . We submitted all of her school records a timeline and waited waited and waited some more. at 130 the Consular Officer,s were out to lunch so they handout a pink slip telling ou to come back at 230 . 2 couples had recieved it. We were called next. My wife expecting a pink slip puts her hand in the little area where you recieve and give documents and a worker tells her pick up the phone he hands her back some photos that were proof she had actually studied in Ny when she came in to the country with the F1 visa, he is like these are yours. Please pay domesa the fee congratulations the CO has approved the visa . No questions of our bonafide relationship none on the first day she was asked two questions how do you meet him and why did you go to new york when your original visa was to ca she asked us to bring the documents supporting her answers . I am astonished so happy Cr-1 visa is en route joe , james thank you for your support and god bless you best of luck to everyone .

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview
