Hello,

My fiancee will arrive here in the U.S. this Friday, June 16th. We will marry in August. We would like to return to her home country, Thailand, in November and have a Thai wedding for her family.

This situation would be Advanced Parole, correct?

Can we file only the I-131 form without AOS ?

Is this sufficient reason for AP?

If we are married and file the I-485 for AOS, according to the I-131 istructions, it is no longer considered AP.

What is it, if not AP?

You apply for AP (Form I-131) along with your AOS (Form I-485) application. You can submit them together, after you are married.

Once the AP is approved, she will be able to travel outside the U.S. and return using the AP document.

If you are getting married in August, and want to travel by November, you better make sure that you submit your AOS and AP applications as soon as you possibly can after your wedding. I got all the paperwork ready before our wedding, and then just attached the marriage certificate after our wedding, and put the applications in the mail two days after our wedding.

If you want to get your marriage certificate quickly, just ask whoever marries you to give you the signed marriage certificate after your ceremony and then you take them yourself to get certified copies (they are only like $3.00 a copy, so get a few to use in the future). It takes quite a bit longer to get the certified copies if you let the person who marries you send them in and then you order them after.

Let me confirm a few things:

*We must be married prior to filing the I-131.

*The I-131 cannot be filed separate from the AOS (I-485).

If you look at the I-131 instructions, it states that if you are married and have file for AOS, it is no longer considered Advanced Parole. Can anyone explain this????

You apply for both the I-131 and the I-485 at the same time. I believe one of the conditions of AP is that an I-485 has been filed and pending with the USCIS.

The I-131 says

You may apply if you have an adjustment of status application pending and you seek to travel abroad for emergent personal or bona fide business reasons;

So, the I-485 must have already been filed, or is being filed concurrently with the I-131. It is not possible to file the I-131 before the I-485.

It is possible, however, to file the I-131 after the I-485.

Where exactly do you see this mentioned in the I-131. I can't even find the word "married" in the I-131.
