Congratulations to browneyedgirl on her marriage.

Fire w wind,

Her finance got his social security card now but unless he got a temp work authorization from his POE his ss card is not work authorized. It should have a notation on it stating something like this:

VALID FOR WORK ONLY WITH DHS AUTHORIZATION. NOT VALID FOR EMPLOYMENT ...
Meaning that is only for id purposes until he has AOS and then he would need to go and get this removed from the card. The temporary stamp from JFK is only good for 90 days if he did indeed get one. DHS Authorization is the EAD card which would be part of his AOS now that he married.

Everything I respond to is from personal knowledge, research or experience and I am in no means a lawyer or do I claim to be one. Everyone should read, research and be responsible for your own journey.

Ok im confused now, the people at the SS office said he is authorized to work with this card while we are waiting AOS

I have a question.

If my fiance gets the EAD stamp at POE we could go to social security office and get a # next day, i.e. before us getting married?

Mary, correct me if i m not comprehending you accurately, you are saying he will not be authorized to work unless he has an EAD stamp but will have a SSN assigned for identification purposes?

If he gets a stamp at POE it is good for 90 days and you can go to the SS office before you marry but he must be in the SAVE system and usually it takes a few days to show his POE entry. Yes the SS card is for ID purposes and will have the note that I highlighted on it. It is good for the 90 days that the stamp is valid and then you go back to the SS office and have them take off the notation once he adjusts status. After the 90 days if he does not have his EAD card he will then need to stop working until he gets AOS completed.

The specific categories that require an Employment Authorization Document include (but are not limited to) asylees and asylum seekers; refugees; students seeking particular types of employment; applicants to adjust to permanent residence status; people in or applying for temporary protected status; fiancés of American citizens; and dependents of foreign government officials. Please see Form I-765 (Application for Employment Authorization) for a complete list of the categories of people who must apply for an Employment Authorization Document to be able to work in the United States.
Located here on USCIS.

And from the Social Security Website for Immigrants.

Work eligibility

For most foreign workers, we only need to see your I-94, Arrival/Departure Record. Some foreign workers also must show their work permits from DHS (I-766 or I-688B). International students must present further documentation. For more information, see International Students And Social Security Numbers (Publication No. 05-10181).

DHS stands for Department of Homeland Security and means the EAD authorization. Only CR -1/IR-1 immigrants are work authorized as far as marriage type visas on their arrival into the USA. All K applicants must AOS for EAD to be able to work legally.

I believe if you are lucky you might get an interview in June, however very slim chances since May 08 or rather if you really mean 09??? is in the second week of may. so probably the interviews for June might already be scheduled. But if you make it then you might have a slim chance, or else it would probably be in July.

Fire w wind,

I am sorry that you are still waiting but am glad to hear that at least you can go back to Pakistan and visit your husband. AP is such a pain and you sure have had a long one too.
