interview is 2 weeks from now..what should I do?

Hello folks, I'm so worried for our forthcoming interview..I've heard a lot of scary stories about income which below the poverty limit that became a problem. I would like to express my apology if this question of mine was being asked before but this time I'm so worried and feeling nervous.

Here we go, I'm afraid that IO will ask us about my wife's income for 2007 which was below the poverty limit. We filed my AOS application on mid of November 2008. 1 month and half after we received a letter to appear for an initial interview. My wife's income for 2008 was above the poverty line but we haven't filed it yet because she's still waiting for her W-2....we would like to file it as jointly so that we will be receiving a good refund but at this time I don't have a SSN yet so we can't file jointly unless I'm going to apply for ITIN....there wasn't any updates for my EAD after my biometric was taken since 12/19/08 but somehow I'm hoping that it will approve soon.....

In our interview, is it suffice to bring my wife's W-2, letter from her employers and 2 months pay stubs for 2008? How can we explain to the IO why we didn't file for 2008 income tax return?

I do have an option though, but I can't figure out which one I really need to take into great consideration:

Is it really pertinent to file our 2008 income tax return for 2008 before our interview even I don't have SSN yet but I will apply for ITIN? and once I have my SSN then I need to file an amended return?

OR......do I need to wait until my EAD will approve and apply for SSN then file our 2008 income tax return but I'm assuming that this will likely to happen after our interview date......

I'm feeling so nervous that this will become an issue/problem during our interview....we didn't seek for joint sponsor because we don't have an immediate relatives in the US.

Any inputs or suggestions will be so much appreciated!!!

Hey dude

I think you should not worry about the 2007 tax income.. when my wife filed the AOS for me.. our lawyer told us that the only one that they look is the most recent one... wich is 2008...

as far as 2009 tax info.. i dont think you should be filling jointly not until well.. of course you have ur ssn and start working..

so.. as long as you guys can prove that she made above the poverty line for 2008.. (job letters, pay stubs etc..) you will be fine..

01-26-09......EAD and AP received on the mail!!

01-27-09......Applied for SSN

02-03-09......SSN Received

02-24-09......Interview at 12:00 pm in San Diego !! APPROVED!!

02-28-09......Welcome Letter Received & approval for I-130!!

03-09-09.......Green card in the mail!
