Hello,

well to my story i filed a I 485 and I 765 last year i got the receipt for my payment shortly after in the mail then nothing for a long while so i decided to check my status online

where i found out that a notice that was send to me was returned as undelieverable to them at the end of february which i don't understand cause my address hasn't changed and i received the receipt just fine.

anyway so i called in and told them that my address hasn't changed and they said they will resend the notice within 30 days so i wait those 30 days and ... nothing

so i call back and was told that my case hasn't been addressed but that they will refile it and that i should get mail within the next 30 days ...yep you guessed right another 30 days passed and nothing

so i called again and was told that they will refile it and that i have to wait another 30 days but that if i don't get it this time and call again i will be connected to someone else to find out why my case doesn't get addressed

i was also told that i could go to my nearest local office to find out what is going on

my problem right now is my nearest local office is in the next town which is a good 6+ hours away and i don't have a car or drivers license so i would have to ask my mother in law to take a day or 2 off just so that she can drive me over there

well i guess what i would like to know is should i just wait till the 30 days passed and hope i can achieve something on the phone or try to go thru the trouble of going to my local office

all this waiting and not being able to do anything aside of calling every 30 days is starting to drain my power and is really frustrating me since i would like to be able to get a job and support my family

instead of living of their money and what little is left of my savings

You need to go to your local office on a infopass as soon as you can.... if it is your interview letter that was undeliverable then the next thing you will get is a denial for your your AOS.... then you will have major problems trying to get a motion to reopen your case and may end up having to start all over again....

YOU MUST GO AND TRY TO GET THIS SORTED OUT NOW....

We had an RFE that never got to us. We went in for an interim EAD and were denied because our case was on 'hold' because we never answered the RFE. They were useless on the phone and at the infopass appointment. The only thing that worked was writing a letter to the NBC to have the RFE resent.

I would..

1. write

2. go to an infopass appointment

3. call

4. repeat

They will eventually deny your case if they think you abandoned it.

Writing (least preferred): While calling can be more convenient, you may instead choose to request an update by writing the National Benefits Center at:

# Your current name and address, and, if different, your name as it appears on your application;

# Any A-number, which is an 8 or 9 digit number following the letter "A", assigned to you or to your application

thanks for the answers

going to have to talk to my mother in law and see when she can take time off to get an infopass interview

which brings me to a new question as what should i file the infopass interview i took a brief look at it and i'm not quite sure what to check

either i just have a question about my case

or

want to talk to an immigration officer

or

It has been more than 90 days since you filed an I-765 and you did not receive an Employment Authorization Card.

i'm pretty much nervous and kinda scared right now if this gets denied over something so ridiculously stupid like this..

i'm not sure if i could go thru all the ####### again >.<

oh and to clarify some points about my story i haven't had biometrics yet or anything

i only send in the forms they sent me the receipt for my payment and thats when the next letter they send me was returned to them

I would definately go to the office and get this sorted out. You should probably check off that you want to talk to an immigration officer and if they aren't helpfull when you get there then ask to speak to the manager. Be a little aggressive with your case and it should get resolved.
