Hello,everyone

I'm new here and need your help! and please pardon my not becoming too knowledgable about this site before posting, but I'm feeling a bit stressed out.

I married American.My husband live in the US and I live in Japan.my husband is preparing to file for my US visa.the problem is he didn't file tax return for 3 years just because was lazy.anyway,he start to pay tax and penalties.He is still paying tax.my question is can we file I-864 even my hasband is still paying tax? or we have to wait to pay the previous years taxes? He is a self-employed programer.

So long as he catches up with his taxes, and has three years' worth of tax returns to provide with the application, he'll be OK. His issues with the IRS about back taxes, interest, penalties, etc. are of no interest to USCIS. While he's at it, he might as well file now for tax year 2008. He is also required to file back state income tax returns. If not, the state will be knocking on his door.
