Has anyone filed taxes with their non citizen spouse?? My Hubby is came in on a K-1 and he's working leagally, and awaiting his two year card. Do we need to file a special way???? Thanks for any help you can give!

i assume he ahs a social security card..and we filed like everyone does..there is n o differnece

But when we turn to the Hebrew literature, we do not find such jokes about the donkey. Rather the animal is known for its strength and its loyalty to its master (Genesis 49:14; Numbers 22:30).

ya, he does. The reason why I asked is I tried to do H &R online, and it wouldn't let us because he's not a usc and that we needed to file a special form, but then I completed my taxes with another company fine, so I started to wonder if I still need to file a seperate form or if the irs will take it. Thanks for the help. Anyone else??

Must have an EAD and one of dem restricted SS cards with some kind of nine digit number on it, just file a joint return, when you get to the point of getting his I-751 for his ten year conditional permanent resident card after is two year conditional card expires, and then applies for his N-400, the USCIS loves to see joint IRS tax returns.

Recall having problems when my wife had an EAD, only good for a year and hope and pray you get that conditional card before it expires, had problems with my banks adding her to my accounts and even said, thought the USA encourages foreign investors, also had problems with the DMV, but she had an international license that my auto insurance company recognized. That all changed when she finally got her 21 month green card, that is when you have to apply for the ten year card and go through all that same ####### again. Ha 90 days before it expires, should make that two years before it expires as slow as they were. Then the same ####### again with the N-400, but she is a USC now.

But never never had problems with sending her tax dollars to the IRS.

If this is your first year filing together, there is a letter that you have to write to inform the IRS....that's why you can't file online.....otherwise you file just the same. Let me see if I can find that section in that publication for you.

Pay attention to page 8 and 9. starting with "dual status aliens" I hope it helps you.

If you have SSN and he is here since March 08, for 2008 & you are married before Dec 31, 2008, you can file married joint - no need to add additional document or anything.

Nov 8 2004 : Received response from CSC that my file is being requested & review will be done

Nov 10 2004 : Email & online status Approved

Nov 15 2004 : NOA 2 in mail

Dec 16 2004 : NVC assigns case number

Dec 20 2004 : NVC sent DS 3032 to beneficiary, copy of DS 3032 & I-864 fee bill to petitioner

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

We filed last years taxes jointly, nothing special to do. It will help greatly if your husband has his social security card, which I would guess he does since you indicate he is working here legally.
