hi everyone,

well i have a question, i haven't been working for past few yrs because of schooling and other issues..im filing for the AOS using my parents income as joint sponsor..so what about me? what paper work should i send in stating that i didnt have to file because i didn't work? please please do reply ..i searched this whole site but couldn't find any answer on this...

also what other documents to send in other than I864A form and the recent tax return of my parents?

What does the sponsor do when he/she was not required by law to file an income tax return during a given year?

If you did not have to file a tax return, attach a written explanation and a copy of the instructions from the IRS publication that shows you were not obligated to file.

i got this from the us department of state website..what should i write in the written explanation ? and how do i get a copy of that IRS publication??

please if someone with a knowledge of this do let me know

Some simply file a ZERO return and attach a copy to the I-864.

Your profile is confusing, are you ADJUSTING STATUS (AOS) per your profile or filing the Affidavit of Support to NVC for a CR-1 or IR-1 visa??

The I-864 states:

If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation.

Basically all you have to do is write a letter along the lines of:

I did not file a tax return for 2005, 2006 or 2007 as I was not required to because I had zero income (or state your income).

thanks for replying..sorry for the confusion with the AOS status ma bad :unsure: ...im filing with NVC for ir1/cr1 and been stuck at the AOS ..

please do let me know what other documents to send along with the I864 and recent tax return..do i need to send in the past 3 yrs tax returns or thats optional?

My husband did not have to file because he was attending school. I looked on the IRS.gov web site and found specifically in a Publication proving that his father claimed him because he was a student. I made up a nice little cover letter looking sheet stating the facts, printed off the page of the publication and highlited the area. I'm pretty sure there is an area that says "if you did not work you did not have to file". Good luck! :)

Hi guys,

I want to know if we get my father in law as joint sponsor (he lived in the same house as my husband, divorced and no dependent) what poverty level we need to meet?

My husband's household size is = 3 (himself, me and our son) as per his I-864 however in his federal tax for 2008 he is single and no dependent.
