Once i receive the k3 visa and enter the United States, how long do i to file for adjustment of status? Is it 90 days like the k1 visa or can I wait about 5 or 6 months to file? And can I work using the k3 visa or do I have to wait until I file for adjustment of status to apply for EAD? I know I still have a long way to go but I like to plan ahead since there's more fees coming our way. Thank you

05-01-2009: Sent DS-230 and Affidavit of Support (Overnight Delivery) Lawyer took his time to fill everything out and delayed our process.

05-05-2009: NVC received package

05-11-2009: RFE thanks to the lawyer again and his assistant.

05-12-2009: RFE package sent to NVC

05-14-2009: NVC received RFE package

05-27-2009: Case finally complete!

The K-3 visa is valid for 2 years and you can file your AOS within 2 years but most of the K-3 holders file there AOS before the 2nd wedding anniversary so that you can have the ten years green card and if you want to work before filing AOS you can file ahead but you need to pay $340 separate for EAD, while filing AOS along with EAD the payment will be included to the amount of $1010 that you are going to pay for AOS, its up to you to decide :thumbs:

Actually, they have up to the expiration of their I-94 card, which for a K-3 is typically 2 years after entry to the USA.

Note: Some K-3's hold on filing AOS until very close to 2 years of marriage, if AOS is approved after 2 years of marriage the resulting green-card will be a 10 year unconditional card.

They most likely will stamp the I-94 with the visa expiration date. They did for my wife when she entered (otherwise could just exit and re-enter for another two years). Rin arrived April 19, 2007; visa expired April 17, 2009; I-94 good until April 17, 2009. What was interesting was when we went to Thailand in Sept 2008 for her children's K-4 visas, they were issued October 2008, but had the same expiration as Rin's (since they are derivative status). Their I-94's were also dated April 17,2009 (first US entry October 2008).

The correct procedure is to stamp the I-94 with an expiration date two years after entry. Even if they don't, that's how long you have.
