You know, I read this somewhere here on VJ a few weeks ago and even one member posted a link on where to find this information. I'm sure if you do an extensive forum search you'll be able to find it.

Also, I'm thinking that if the USCIS still has the I-134 listed on their site as a valid form, it can still be used at the embassy for K visas.

since the affidavits are reviewed at the consulate... it may or may not be fully implemented even if it is some sort of a new directive

I'm thinking the same thing. It also happened with form OF-169 when it was replaced by form DS-2001, it took a while for changes to take place at each embassy.

another question , we want to proceed with the non immigrant visa , how long it will take for the AOS ?is it processed in service centers or local offices?

I'm assuming you're talking about the K3 visa? In that case, the AOS will take about 6+ months to be approved but a work permit can be approved within 3-6 months. The instructions on how to file can be found in the GUIDES tab. The petitions are processed by one of the two service centers.

sorry considering i,m filing in California , if i proceed with the K3, nd both I130 ND I129 were approved same time (which i guess the normal ) and i processed the non immigrant visa , it will take me almost 3 to 6 months to recieve the Green Card? is this correct?

Contact your embassy. In the Philippines for a K3 non-immigrant visa they use the 134. The 864 is used for the I-13 through NVC. My wife is going to her interview on February 2, and I asked at the embassy several times to be sure of which she is to use, and that is what they clearly told me. I think it depends on the embassy you go through.

It depends. Once the K3 visa is approved by the US embassy and your spouse travels to the US, he/she will have to file for AOS (Adjustment of Status) along with the I-765 (work permit) if he/she wants to work while permanent residency is approved. The I-765 takes about 3-6 months to get approved, some people get it approved earlier, others take longer. And the actual residency, the approval of the AOS, can take 6+ months. Again, some people get it approved in less than 6 months and others have taken over a year.

One last thing. If you haven't filed yet, it would be a good idea to do some research here on VJ on the CR1/IR1 visa. In most cases this takes just as long as the K3, depending on the embassy, and once the beneficiary enters the US, they get their green card in the mail within a few weeks. No need to file for AOS and not need to wait months for it.

Two things:

Check the embassy's website to confirm which affidavit they use. Usually it's the I-134 for the K-3 non-immigrant visa.

A sponsor, by law, can't be required to sign on for ten years for a non-immigrant visa. Some consulates want the same level of proof that the I-864 provides that there won't be public charge issues.

Secondly, I don't recommend coming on a K-3 visa unless there are very special circumstances. We are going through multiple post K-3 hassles now and it is not worth it. Unless you are in a special situation or the particular embassy approves K-3s more readily than CR-1s, don't bother. If you enjoy doing tons more paperwork, re-entering the USCIS black hole, paying them more money, not being able to get a driver's license and not being able to work, then go ahead.
