Hi there,

Just need some help on apply for a spouse base Green Card?

I am married to a US citizen, for the past 2 years we are living in UK and are in no rush to go to USA. Green Card is just a option for us. I want to apply for the Green Card as soon as I can, so my question is can i apply for a Green Card straight not the K-3 visa. Or I have got the wrong end of the stick.

Any help is great thanks.

If you and your spouse are not thinking of moving to the US in the next year then you can't get it.

If you are thinking of moving to the US, you should do the Direct COnsular Filing process for IR-1 visa since your marriage is over 2 years old so you will receive a 10-year card. Read through the guides for DCF, and there are posts of people doing DCF from Britain, and if you have questions come back here so we can help you get an answer.

If you and your spouse are not thinking of moving to the US in the next year then you can't get it.

If you are thinking of moving to the US, you should do the Direct COnsular Filing process for IR-1 visa since your marriage is over 2 years old so you will receive a 10-year card. Read through the guides for DCF, and there are posts of people doing DCF from Britain, and if you have questions come back here so we can help you get an answer.

You would receive the card only after entering the US using the IR1 visa. The visa must be used within six months of receiving it. So, don't file the petition until you're sure you wish to become a permanent resident of the USA. Filing to visa is 4 to 6 months and then you have six months to move to the USA permanently. Also google, "maintaining permanent resident status" to understand what is meant by "permanent resident".

No ability to go direct to greencard when residing outside the USA...

Also, keep in mind that having a green card means that you will have to live permanently in the US. It is not supposed to be used as an entry pass to the US while living abroad.

About DV visa & Green Card:

1. You can just be an outright foreigner with no right to come to this country.

2. You can obtain a visa that allows you to spend a finite amount of time here, usually for a discrete purpose.

3. You can become a permanent resident, which allows you to live here indefinitely with almost all of the rights of a U.S. citizen.

4. You can be a U.S. citizen.

People in the first category need to get a visa before they can start worrying about anything else. Those foreigners who are in the second category - here on a temporary visa - who are hoping to get promoted to the third category - permanent residents - need green cards. The only real distinctions between green card holders and citizens is that only citizens can vote, can collect some sort of government benefits, and can never be deported.

like some people were (kinda) trying to tell you, a green card is for people who want to live and work in the us, so maybe wait until you're sure you want to move before applying?
