Hi,

USCIS had recieved my I-485 in jun 2007 and I had applied for an EAD later and received it in 2 months or so. As I researched that most people receive there conditional green card around 1 year or so but till date haven't recieved anything. In 4months it'll be 2 years of my marriage, so my question is that if I don't receive my conditional green card within that time then can I do something through which I can get a Permanent greencard instead of a conditional greencard. From what I know the conditional greencard is issued within 2 years of marriage. What about after 2 years? Please let me know if anyone has had such experience...!!! :thumbs:

If you by the time you interview, you have been married for two years they will definately give you the ten year green card. I want to get an appointment at a local USCIS office, but at the same time, since you have waited this long, maybe try and wait for the four months so that you go there and get the ten year card. I dont know how urgently you need it. AM sorry about your predicament. Good luck

Yes, if u been married for less than 2 years u will recieve 2 years Green Card, but if u beed married for 2 years or over. u will be recieving 10 years Green Card, but wait u said u been waiting for ur card since 2007 and this is a lil bit a lot. and u never had ur interview for ur Green Card right??? then i cant tell you, you are under FBI name check !!! so u better call the USCIS and ask them about ur case or go to USCIS in ur local and ask them whats going on. ..

and did u get any touch on ur case since then??!!

Latest on my case is a letter which I received in Sept 2008 that my case has been approved and is transfered to my local field office and that I should contact them for any further enquiries. My EAD also expired and I had to pay the redicilous fees again to re-apply which again is pending since Nov 2008 :unsure:

My question still stands the same, if I don't get a call for the interview for another 4 months then it'll be 2years since I'll be married. Will USCIS itself issue a permanent greencard OR do I have to file something OR request them at the time of interview?

I hate the immigration procedures as they never do anything in-time...grrr !!! :angry:

If you say you got a letter saying your case has been approved and you still haven't got your card yet, it's time that you make an infopass and find out what is going on, not wait another 4 months to see if they will give you a 10 year card

Well did you contact the local office or not? Infopass and ask what to do - could be time for lifting of conditions now but can you do it without a two-year card? Infopass.

Well did you contact the local office or not? Infopass and ask what to do - could be time for lifting of conditions now but can you do it without a two-year card? Infopass.

There is no telephone number through which I can contact them. I wrote a letter explaining the situtation and received no response. Anyways, I am willing to wait for 4 more months as I might receive a permanent greencard instead conditional. No point getting a conditional card now as again I have to wait for 2 more years to remove the condition.

If I receive a permanent GC instead conditional GC then I can apply for citizenship in a year. So I guess it's best to wait a while and then if nothing happens, I plan to hire a lawyer and perhaps file a writ of mandamus.

Infopass: There's a problem with the infopass as well, in my case. My case shifted to Fairfax,VA but technically it should have been at Baltimore field office, so when I make infopass appointment it doesn't make one for Fairfax office but instead Baltimore. And I don't want my case now to transfer to Baltimore and cause further delays.

HAS ANYONE HAD SIMILAR EXPERIENCE...?

Just for your info, the number that was listed for FBI will not tell you if you have cleared the name check, they will only tell you if USCIS has accepted your fingerprints, that's all. Good Luck

Hi Again.

If u said that u recieved a letter from USCIS telling u that ur case has been Approved. that means u dont need Interview. so allow 2 to 3 weeks to recieve ur Card. but wait. do u know when ur case got Approved? if not the day u recieved ur letter that means ur name under check!
