Fiances child question?

Timeline

I have not filed any paperwork yet for the Fiance visa but I have a question. My fiance in the Philippines has a 4 year old son. The loser who fathered the child ran out on them and has never been part of the childs life. They were never married and the fathers name is not on the birth certificate. Does she need to get his signature to take the child out of the country ? What if she can`t get it or he refuses to sign ? As I said he, to my knowledge has never even seen the child but he is aware the child was born. Any help you can give would be greatly appreciated. Thanks !

Be sure you include the child on the I-129F. Also have moms get at least 3 certified NSO BCs of hers and the childs. They'll need one each at the interview and other ones when they are in the US. Easier to get now when she's still in RP.

Have her get CENOMAR also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Nor married, the child carries their mothers last name, they have a passport with the mothers last name, get a cenomar from the NSO = you're set.

Embassy: " I see you have a child but the father is not named on the birth certificate, who is the father?"

Applicant: I don't know

Who will the embassy require a consent letter from?

Yo Steve!

NSO is National Statistics Office. Your lady can go to her local NSO office and get her and childs NSO BCs [birth certificates].CENOMAR [Cert of NO Marriage]. Also have her get NBI clearance [police clearance in Philippines.]from National Bureau Investigation.

If she was overseas for more than 6 months since turning 16 she will have to get police clearance from that country also.

She needs a Passport from DFA [Dept Foreign Affairs] for her and her anak also.

Who is the father? BOB blah blah

Who will the embassy require a concsent letter from? NONE........As long as the child has a passport under the mothers lastname. The passport is legal documentation that the child can travel.

These answers are PI specific. If the father's name is not on the birth certificate, no permission is needed. This is not true in all countries.
