WOW!

First I would like to thank all of you who replied to my question with such haste!

If only USCIS was just as fast!

Now let me explain my story so that everyone will understand my next questions...

I have been living with my wife in the philippines since may 2008...9 months now...

We are expecting our first child this coming May '09...

USCIS approved both the i-129f and i-130 petitions just last week (jan 15 '09)...

questions:

1. Is it possible for me to file all the paperwork while im still in the philippines?

2. What do i do if my wifes visa is not approved before her due date?

all information will be greatly appreciated

I take it you didn't file a DCF? If not maybe you can change over but I doubt it. You should call the embassy and find out if you can change to DCF.

Have the baby in RP and file for CRBA

For one thing ! You have to prove domicile in the US.

DCF cannot be filed since the petitions were already approved by the USCIS (according to the OP).

The only thing you need to take care of now is the Affidavit of Support documents, the I-134 which needs to be notarized (you can do this at the US embassy) and the income info. You'll find the instructions for this when you download the I-134 from the USCIS site.

If your wife's visa is not approved, you will need to find out why it wasn't approved and ask the CO what you need to do in order to get it approved. He/she will tell you what needs to be done.

As for the baby's US citizenship, you will need to take his/her birth certificate to the US embassy to register the birth and get him a SS # and a US passport.

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

The new I-134 form needs no notarization. Chances are, when you get the visa, it will be too late in her pregnancy to travel.
