Timeline

Hi, after looking at few websites I decided to join this one. My journey will start soon. Hopefully everything goes smooth. First I was going to pay a legal service to help me with the paperwork, but after I found out that is not that complicated to do it. I decided to do everything myself and save the $2,500.00 that I was going to pay. My story is the following: got married about 3 months ago in Vegas.. which was a fantastic experience, anyways my question is: For the form I485 I am running into a problem, few years back wanna say maybe 4 year ago. My mom was misled to file for adjustment based on a scam, at that time it did not seem like a scam so we filed papers, then few months it turns out that my case was closed. I went to a lawyer and he said that I should not worry about. Just whenever I will have to file again, I would have to explain myself, thats what I plan to do. So when i am filing out the form, for the last part letter A on part3 processing info, I have to say yes and explain and also include the paperwork that I got that my case I was closed right?

Sorry about the long post, but I just want to make sure. If anybody can help me. I will appreciate.

May depend on why the first case was opened and then closed!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Ok Maybe I got some people confused. Let me try again.. About 4 years ago, my mom was misled to file for adjustment, but the person who told us about the process said that it was a family package, that means she could include me on it. I was hesitate to do, because I did not see any basis to it. But in the end, I decided to do. It turned out that I got a letter saying that I had to proof that was here on 1982, which I wasnt of course.. i was born on 1983, so the letter said if I did not send anything my case will be closed.

But now, I will start a new process that My husband is the usc and I am the beneficiary

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

I came here on a B2 visa.. Originally from Brazil.. and I dont like to use that word..so I like to say that I overstayed.. lol

I think I may have misposted this elsewhere, sorry.

Hello,

I am new to this site and am a USC. My fiance is in the USA currently on a J-1 visa without a 2 year home return requirement. We plan on legally marrying before her I-94 and J-1 expires. I have a few questions that I have not been able to find after researching this site and was hoping that someone out there could help.

1) Should all of the forms be filled out with her new married name or can I use her maiden name on the forms. I'd like to keep it consistent, however, we did the medical exam prior to marriage and it will have her maiden name listed.

2) So far I believe that we will need to file the following: I-130, I-485, G-325a (for both), I-693, I-765, I-864, affidavits of support, cover letter. Am I missing any?

3) Her I-94 will expire a couple of months after we make formal application to the USCIS. Will the pending AOS provide legal visa or will a letter after they receive the application grant her temporary legal status while everything is being processed? She would like to go to school during this process while waiting, is that feasible?

4) I was born in Europe to parents who were both USC so I have US citizenship. I have a US passport in hand. Are copies of every page of my US passport proof enough to satisfy the nationality requirement or will I be required to include a "certificate of citizenship" when I came here at age 8 (I don't think I have one or cant find it)?

5) My fiance currently has a SSN but no Alien number or USCIS number...can I just put "None" in those applicable fields?

Hi Vizaviz. You should probably start your own topic so your questions don't get hidden in someone else's thread. I have answered what I could in red.

Kpic, hopefully someone will be along who has had experience with your issue but to answer your initial question, yes you must declare any previous petitions and follow the instructions on the application.
