Hi Vj's

I have a question for all you ...I have a friend who is US now, he wants to file a petition for his Mom and his little brother, but reading the Uscis web site, for his little brother is not the same time as for his Mom...NOw he is worried because there are nobody to take care of the little boy if his Mom go to US...

He is going to file the I-130 for both, but Do you think he can Expedite his Brother's case in order to get the appoval for both at same time?? because his Mom has no one to help her with the little boy who is 10 years old.

Any advice will be great...

No expedite, Mother is an Immediate relative, a sibling is not.

I-130 for mother results in an IR-5 for a parent of a US citizen, I-130 for sibling gets placed on the long hold for a visa number for family forth class (F-4). If your friend is NOT a US Citizen, your friend can only file for a spouse, or their own children.

May be faster for mother to file for son once mother immigrates and gets a green-card, however this too can take some time unmarried child of an LPR has to wait for a visa number under the F-2A class.

The US does not care about the brother's age or if he has no one to stay with while his mom immigrates to the US. So if your friend wants to file for both, he can file for his brother first, wait at least 10 years and then file for his mother. Or he can file for his mother now, find someone who can take care of his brother, have her file for him and then wait another 5-6 years for his brother's visa.
