Hi Guys,

I need some help for a friend in the Philippines who is married to a USC and they are still waiting for NOA2 at the moment. They've been married nearly 2 yrs now and things had change recently with their relationship. Just last December the came back to the Philippines to supposedly visit the wife but he only stayed there for 2 days. He confessed to his wife that he has another girl in manila and he is no longer in love with his wife. He told her that he arrived a week early and stayed there with the girl. The wife was devastated about it but still hoping that the husband will come back to her. Anyway after he came back to the US he tried ignoring her. Just 3 days ago the husband called the wife telling her that he has a big problem. He said that she needs to sign a divorce paper because his previous marriage to his was not final when they got married in the philippines and the ex wife is filing a case to him about bigamy. Anyway, my question is : IS this possible that the divorce was not final?

I dont this THAT is Possible coz 2yrs ago he knew what he was doing and when filing either129 or 130, it asked abt any previous marriages/divorces.

He just trying to get his filippino wife lost.

That was I thought too , maybe he plan to file fiancee visa to the girl.

dont sign...he is trying to get a quickie divorce.

ex-wives do not bring charges of bigamy...prosecuters do.

any open issues from a previous marriage have nothing to do with a subsequent marriage.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Considering they got NOA2 it seems unlikely that he wasn't divorced properly, but there is a small chance it is possible. Considering the other problems though, it sounds to me he is lying to her.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

yes he can.

service by publication in the leagal section of the newspaper. He was just trying to swave the cost of doing this, by having her sign and acknowlwdge to complaint.

Have the guy send her a copy of the complaint, but do not sign for certified mail.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Sad naman niyan. I think he just want out of the marriage, but before that alibis..there might be another other reason behind what he said..I hope your friend and husband could still save their marriage..sayang naman. Btw, thanks sa reply my AOS was approved without interview and all..blessing talaga!!

yes he can.

why wouldn't she sign the divorce papers? I mean is obvious is a lie what he claims, but is no surprise, considering what he's doing. he's just that kind of person. waiting for an year to find out u r being dismissed is horrible, but at least she didn't start a life with this man. I think no one can even hope for happyness with such a person. and is not someone u'd still want to be married with. if was me, I'd sign him the papers and get rid of him as fast as posible. so what if that's making things easier for him? he'll have to live with himself for the rest of his life, and my guess is that isn't nor the first nor the last time he gets in a situation like this. and the other girl, if she knew he was married and still get in the way, her 'reward' will come from him sooner or later, no worries. makes no sense to try keep him or make his life harder. will have the same end, but will consume her more. sooner she gets over with it, sooner she can go on with her life. trying to punish him will affect her negative too. and no worries, life has ways to payback. u dont have to waste yr time and energy to do it yrself.

my husband goes back and bags with our papers get lost : 5th jan 2009

package IV fee bill generated and paid online: 7th jan 2009

recieved bags and papers: 9th jan 2009

sent AOS package: 9th jan 2009

package IV bill shows PAID and sending package IV : 12 jan 2009

case complete: jan 20th

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless

Actually if he wasn’t divorced he would not need to get the second divorce to the Filipino wife as the marriage would not be legal in the first place. But knowing what I have been recently through with getting married in the Philippines, unless he lied and said he was never married he would have to have brought certified copies of the divorce decree from the previous marriage. And they kept my copies so I had to get new ones again when I filed for my K3 in the states.

It sounds more like he is trying to pull a fast one on his wife and snooker her into a quickie non contested divorce. Tell her not to sign, and contact an attorney in the states, since the husband is such an #### tell her to ask for spousal support. Lol that will get his goat.

One thing she can do if she doesn’t have the funds to hire an attorney and can’t get into the states to fight the divorce tell her to write a letter to the court and explain her situation with money and the visa. Most courts will assign an attorney for her defense at the husband’s expense if she asks for it.

I think the guy is lying. I think he is a pig also. When I went the the Philippines, as most know who have gone there,

you have to go to the embassy and provide documentation that proves that you are legally capable to marry.

He would have had to prove that to get the documentation necessary to marry is current wife. Sounds like to me that

he is just lying to get the quick Divorce, then marry the new woman in Manila. I feel sorry for both the women involved. What a scum bag :bonk:

Why would you want your friend to work it out with a deceptive man such as this? Who gives a flying rats you-know-what about what happens to him, but she needs to be able to move on in life and hopefully find someone that can treat her with respect. She should do what she needs to do to achieve her own personal success.
