hello everyone!

i had a question regarding the birth certificate my husband has to send in with the ds-230. the problem is he doesn't have a birth certificate. afghanistan doesn't issue out birth certificates unless requested and they have just started to issue birth certificates to newborns. so should i write a letter and send it in to NVC with the ds-230 explaining the situation or should my husband try and obtain a birth certificate, which would probably be impossible. he does have an afghan form of identification that i can send in if that will do.

btw does anyone know whether or not islamabad embassy allows the spouse to attend the interview also? just wondering!

I'm pretty sure it said on dept of state website that the applicant can have his mother make a sworn affadavit of where and when he was born.... not sure about that.

I wanted to add a question about birth cert. My father is I 864 joint sponsor and can't find his birth cert. and doesn't have a passport. What other options do we have to prove citizenship?

We had the exact same problem. We submitted our package in November '08 (still waiting on Approval), and have a lawyer who told us that it should be fine to include a copy (you can just scan it) of the National ID that your Fiance has and then an English translation of that ID (that your fiance can get there in the country as well.. make sure it's stamped with a goverment seal). The translation looks just like a Birth Certificate and has all the required information.

As far as being together for the interview, I'm waiting to find out about that too. We're actually trying to find out right now if we are able to change the interview to Dubai (for safety reasons). I'm in the US Military, so going to Islamabad is off-limits to me :(

I hope this helped, however, I'm not an expert, and we could recieve an RFE (request for further evidence) in the coming months asking for a better form of "birth certificate".

I guess you can get a letter from the authorties stating that they can't or won't issue the birth certificate; then the parent ( mother) can make an affidavit, send it with any secondary date of birth proof.......

Unobtainable birth certificates

The applicant’s birth record may not be obtainable. Some reasons are listed below:

The applicant’s birth was never officially recorded.

The applicant’s birth records have been destroyed.

The appropriate government authority will not issue one.

Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

The most universal and accurate document in Afghanistan is the identity card (taskera). In addition to the name of the individual, the father and paternal grandfather's names are provided. The year of birth (approximate for older persons) and marital status are also furnished. These have been superseded by "party cards" issued by seven different political groups inside Afghanistan.

i don't think it would be that easy to get a sworn affidavit from his mom because she's in a completely different province than him. i could ask his father for one if that would work. if that doesn't work i guess i can send NVC explaining the situation and send in his national ID instead.

You can access the DOS link of the applicant's civil documents needed to send along form DS-230. It says:

Unobtainable birth certificates

* The applicant’s birth records have been destroyed.

* The appropriate government authority will not issue one.

Please obtain a certified statement from the appropriate government authority stating the reason the applicant’s birth record is not available. With the certified statement the applicant must submit secondary evidence. For example:

* A baptismal certificate that contains the date and place of birth, as well as both parents names (providing the baptism took place shortly after birth)

* An adoption decree for an adopted child

* An affidavit from a close relative, preferably the applicant’s mother, stating the date and place of birth, both parents names, and the mother’s maiden name.

Note: An affidavit must be executed before an official authorized to take oaths or affirmations.

According to the USCIS, these are the documents they accept to prove US citizenship:

What Documents Do You Need to Show That You Are a U.S. Citizen?

1. If you were born in the United States, a copy of your birth certificate, issued by a civil registrar, vital statistics office, or other civil authority.

2. A copy of your naturalization certificate or certificate of citizenship issued by USCIS or the former INS.

3. A copy of Form FS-240, Report of Birth Abroad of a Citizen of the United States, issued by a U.S. Embassy or consulate.

4. A copy of your unexpired U.S. passport; or

5. An original statement from a U.S. consular officer verifying that you are a U.S. citizen with a valid passport.

6. If you do not have any of the above documents and you were born in the United States, see... "What If a Document Is Not Available?"

What If a Document Is Not Available?

In such situation, submit a statement from the appropriate civil authority certifying that the document or documents are not available. You must also submit secondary evidence, including:

A. Church record: A copy of a document bearing the seal of the church, showing the baptism, dedication or comparable rite occurred within two months after birth, and showing the date and place of the child's birth, date of the religious ceremony, and the names of the child's parents.

B. School record: A letter from the authority (preferably the first school attended) showing the date of admission to the school, the child's date of birth or age at that time, place of birth, and names of the parents.

C. Census record: State or Federal census record showing the names, place of birth, date of birth, or the age of the person listed.

D. Affidavits: Written statements sworn to or affirmed by two persons who were living at the time and who have personal knowledge of the event you are trying to prove. For example, the date and place of birth, marriage or death. The person making the affidavit does not have to be a U.S. citizen. Each affidavit should contain the following information regarding the person making the affidavit: his or her full name, address, date and place of birth, and his or her relationship to you, if any, full information concerning the event, and complete details explaining how the person acquired knowledge of the event.

i called NVC a few minutes ago asking about the police clearance and birth certificate. my husband has been running around all of kabul trying to get a police certificate but they won't issue him one. so NVC told me that since afghanistan's police records are unavailable, he doesn't need one. i asked about the birth certificate also since no hospital would issue him one, and they said just send in his afghan national ID (:

phew. that's a load off our chest.

hope everyone is having a smooth ride at nvc! (:
