First of all I'd like to thank all the posters and Visajourney for the good work. I filed for my wife's K1 visa and it was successful and took less than 7 months because of all the good information I got from all you guys. Now I just filed for a visa for my Mom to come over about 6 months ago, she should be picking up her visa in a couple of days. All you folks that answer peoples questions am very appreciative to each and everyone of you. Now that I have some knowledge about K1 and bringing a family member over I will start shearing my experience hopefully it helps someone else.

Anyway my question is this, after Mom get into the Country do I have to file another AOS like I did for my wife? How does she get her green card. I know I have to get her a SS number for sure but I'm not too sure about the Green card, and I did a search on the USCIS website and can't find any info.

Once again thanks guys and God bless. :thumbs:

My Mum arrived in mid November 2007 and received hers in the mail in January 2008. Also we went to get her ss number, but I had applied for one when I did her application, so they said we didn't need to do it again. That arrived around the same time.

This is if you are filing for adjustment of status from a non-immigrant category...

Your mum is arriving as an immigrant

If you are filing under one of the following categories:

Spouse, parent, unmarried son/daughter under age 21 of a U.S. citizen with an approved or concurrently filed Form I-130;

Beneficiary of an approved Form I-130 filed by a qualifying relative;

Qualifying derivative, family-based beneficiary;

YMMV

I dont see the OP saying exactly what visa the mother has been approved for. We are just assuming it is a IR-5 Immigrant visa, But for all we know it could be a B1/B2 tourist visa and that is why he thinks he needs to adjust her status.

shenanigans, you need to give us some more information before we can say for sure exactly what you need to do next.

true, but if it was B1/2 the OP would not have applied (petitioned?) 6 mos ago...

I would be very surprised if it is a IR-5 approved in 6 months, It is taking 6 months or more to get the I-130 approved and then it has to get through NVC and then the Embassy in the home country. Most parents I have seen go through the process it take about 12 months from first filing to getting the visa in your passport.

Hopefully the OP will come back and we will know for sure.

but if it is not an immigrant visa... proposing already an attempt to adjust status from non-immigrant would be a no no

Thats what I mean. We should not assume it is an immigrant visa as it could be a tourist visa and he is getting the wrong info from VJ members.

Thanks for all your response guys, sorry it took me this long to reply just been very busy at work. Anyways yes I did apply for the Immigrant visa and yes it did take just a little over six months for it to get approved.

The I-130 was approved in about 3 months maybe even less than that. Then it was sent to NVC. I had my fee and the Affidafit of support all filed out and ready to be sent out the same day I got a letter requesting it and other documents. By then my Mom already had her DS whatever form police records birth certificate and other records all sent to me and I soon I was request to send those I had it in the mail through Express mail the same day.

I got the letter letter of invitation in the maile Dec 18 and her interview was on the 20th of January. I'm always one sept which makes things go a little faster.

Wow Good Job.. As your Mom will be arriving on an immigrant visa her Greencard will arrive in the mail within about 10 weeks. She will get a I-551 stamp in her passport at the POE and this acts as a temp Greencard until the plastic one arrives.

There is nothing else you need to file, she is done with USCIS until she needs to renew her Greencard (10 years time) or if she changes her address or if she wants to become a Citizen (5 years after entry)
