I'm new! Have few general questions!!

Hi everyone! I'm a new user here!

I have tons of questions.

My fiance and i just got engaged in december. He's from Honduras, I'm from Dominican Republic but he lives in USA.

He's a resident but he just started the process to become citizen, the naturalization.

So once he completes it, and gets the citizenship, we are gonna get married.

So which is the best way to do it? Here or in USA? I was reading and I would prefer in USA, but do I have to enter with a K1 visa??? because I have B1/B2 visa but i heard is not legal to go there with that visa and get married??

Is it better to get married with the citizenship process done, instead of the resident card? is it truth that if we do it as resident it will take too long?

Hi Carolita. Welcome to VJ. :)

It's perfectly legal to enter on another visa and get married. What is not legal is to enter with intent to stay, and then adjust status bypassing the visa process. If I recall correctly, I believe the wait for a visa is quite long in DR, so you may want to pop over to that forum and introduce yourself and/or look around. Latin America, Mexico & the Caribbean

Yes, definitely it is much quicker to marry as a citizen.

Welcome to VJ, and congrats on your engagement.

You have lots of reading to do but here's how i am going to do it, maybe will help give you ideas when making your own choice.

I am the USC, and my boyfriend has never been in the USA. I did lots of reading to see what was the best route for us since we had several choices:

1) Apply for a Fiance visa, once he gets here get married. (only citizens have this choice)

Ok it is faster but once he gets here on this visa we have only 90 days to get married, and he needs to apply for a greencard and the works (more money!) .... so pros: faster , cons: more money and needs to apply for permanent residence here... we decided to go against this choice...

2) Get married in DR, once I come back to the states petition for a spousal visa (both residents and citizens can do this but faster for citizens)... It takes longer for him to come but he will enter the usa as a permanent resident (conditional green card since the marriage will be young) and we just need to remove conditions of the green card later on... It is cheaper than the fiance visa but takes longer, since i am still in school and not ready to live with him just yet this is the way we want to go... Besides we also took into account the fact that his family lives there and cannot travel for the wedding, my family can just travel...(there is also the option of applying for a k3 visa if u go this way! read up)

3) there is also direct consular filing, dont know much about it because we already decided on the option above...

So for us several things came into play, family on both sides being at the wedding, money, and time apart... Our relationship is long distance and we felt confident that we wouldn't die if we waited just a bit longer by going the CR-1 route. Makes sense financially for both of us and the wait will give us time to save money for our home together.

Thanks a lot!!! We haven't discuss a lot about how r we gonna do it, im just starting to find out information. I just thought it was a lot easier hahaha! anyways, as he is still dealing with his citizenship status, he's in that process now.. we have to wait... But i don't wanna marry him and come back and wait here, so maybe the best choice is the k1 visa...

Is just that everything takes so long here!!! Is different for me because i already finish college, and i have been for almost 3 years with my so, so i just wanna be with him :)

Hey another question... does it matters that once he gets the citizenship, we start the k1 process right away, or do people wait a couple of months or more.. or whats the deal?? Thanks!!

Your fiance can apply now as LPR and once he becomes citizen, he can upgrade the petition calling to USCIS and sending a copy of the naturalization docs.

You can take advantage of the time this way, I am going thru K1 myself even when I have a B1/B2 visa since a long time ago. I went yesterday to Clinica Abreu for the medical test. My interview is on March.

Or better you both can get marry and apply for a CR-1 this way you get the green card when you enter to US, in 2 or 3 weeks and you don't have to wait for the adjustment of status.

I didn't know about it, that's way we I didn't do it this way.
