Is 2007 tax return valid for AOS application in March?

Hi to all!

My husband and I are planning to submit the AOS application first week of March 2009 for 2 reasons: the $1010 and tax rebate.

My question is , is it ok to submit an AOS application in March 2009 with 2007 tax return? since the deadline for 2008 tax return is April, I am thinking that the March AOS application will still be covered by the 2007 tax returns. And also, I am considering my husband's tax rebate for 2007. I dont have my SSN yet and if my husband files for 2008 tax return along with w7 for my ITIN , he wont get his tax rebate.

Will the AOS application submitted in March be rejected if the tax return is not 2008? or will the immigration just send us an RFE for 2008 tax return?

please help me. thanks

This pops up every year around this time - I think at most you might get an RFE (which if you do, the April 15 deadline would have likely passed so you'll have your 2008 return). :thumbs:

Rin had her interview in April 2007 before I had filed my taxes for 2006. At that time, I had my tax transcripts from 2004 and 2005. I "roughed in" my taxes using TurboTax for tax year 2006 (and noted on them that I had not filed them as yet).

Did the same thing again this year, tax year 2007, for AOS (submitted a turbotax copy of our taxes that had not been sent to the IRS). I filed for a six month extension with the IRS in April. Then we filed AOS for Rin and her three children in June 2008. They received their EAD in late August and SSN in September. Once we had the SSNs, we filed our 2007 taxes in September (the difference between $0 rebate and $2,100 - well worth the wait!).

So my suggestion: File AOS with an approximation of your taxes for 2008, but label them as such. Once you have your EAD, get the SSN and submit your 2008 taxes. There you have two choices - 1) file by April 15th and later submit a 1040X (amended return) once you have a SSN; 2) file an extension and file your taxes once you have a SSN.

08/22/2011 - Mailed N-400
