WOW!! Not even one person encourages us to start with that. It seems that you are all sure that they won't approve the petition, will they?!! Can't I just say that we hadn't met because I was denied a visa.

Anyways, I think that meeting in a neutral country is the best thing to do. In that case, I will need to keep some photos for us and copies of our tickets maybe. Anything else?!!

Any other opinions, please.

You can't meet in a neutral country without her leaving the US. If you do though, the passport stamps and boarding passes are considered "primary evidence" of the meeting in person requirements. Tickets prove you bought tickets, not that you traveled. Photos are secondary evidence but of course you'll want to take many and include a few.

Just to make you happy though, I'll be the maverick and encourage you to file without meeting. It won't succeed but our government could use the $455 donation, particularly if it's coming from you, the foreigner. :devil:

This is not about opinion, this is about fact.

They will NOT approve your petition unless you have met in person, case closed.

Do you think they will just waive it because your fiance doesn't want to get on a plane?

If they were that lax with the rules, people wouldn't have to fight this hard to be together.

The only way you'll get approved without meeting is if you have signed documentation from a doctor stating there is a medical reason as to why she can't get on a plane or, some religious documentation that states it's against your beliefs to meet before marriage.

That's it...end of story.

I'm not meaning to be blunt, but that's the reality of this situation.

Get her to swallow her fear or whatever it is, get on a plane and file the papers after the meeting.

Also, the religious exception exists, but there is no religion on the face of the earth that I know of that doesnt allow for meeting before getting married. Might be some tribe in the Amazon jungle, but not in any part of the first and third worlds.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

You can meet in a neutral country. She don't want to fly then I suggest Canada. Canada is lovely this time of year and also they seem to allow most people in for visit.

I happen to know someone that couldn't go to fiancee country because he was denied visa. He and her met in Mexico. It was either Cancun or Cozumel. They took many pics and put in for a K1. He eventually got the visa for her but I do remember it was still hard. Just have to be patient.

Just to reinforce what has already been said, you can look at the cases of people who have gone before you.

Go to www.uscis.gov, click on the "Laws and Regulations" link at the top. Then click on the "administrative decisions" link on the left.

From there, click on the "administrative decisions" link near the bottom of the page, and search for "D6 - Fiancees and Fiances of U.S. Citizen (K-1)".

Now you can look at the administrative decisions issued in any year you like. It shows cases that were denied and appealed, and what decision was made and why.

You'll note that somewhere around 1/3 of the K-1 cases that reach this stage do so because the petitioner and beneficiary didn't provide proof of meeting in person during the required time frame. Every one of these cases that I've seen was denied (I haven't looked at them all, though, so maybe there's an exception somewhere). Failure to provide proof of the in-person meeting seems to be the biggest single reason for denial of K-1 cases.

If you're bored and/or you want to see the reasons for other cases' failures so that you may avoid them, there's lots of interesting reading there.

Hello,

I'm so happy that I found this place. Now I can post everything that will happen to me and my future wife. We can post together and hopefully get the encouragement that we really need.

Anywas, she wants to apply for a k1 fiancee visa for me with USCIS. We just need to know one thing before we start with this. I tried to apply for a visitor visa but was denied twice. And she doesn't want to leave the U.S. So, one requirement is missing here. We have never met. But we have been corresponding for 4 years now. We have sent photos and always talked on the phone. I just wanna know if it is at all possible to apply for the k1 visa with a reasonable explanation for the lack of that requirement. Is it at all possible to start?

why wouldnt you wanna meet your fiance first??? what if you dont like each other in person??...........never meeting someone in person

and going thru this emotionally draining journey thru the governments to marry, you better be sure you met that person and this frustration is what you and her

want to spend the next 6 + months doing depending of course your country......and not to mention

the cost of this ride thru the system..........

There seems no way around the having to meet within two years issue. They stand very firm on that.

I'm sorry to say, but everybody here is right, u have to meet prior to filing the petition. Besides, how come you are ready to leave all your life behind and move to the US to live with somebody u haven't even met yet. U obviously can't go to visit because of the visa denial, but ... your fiancee doesn't want to leave the US.... Is there a serious reason for that? Or she just doesn't want to get on a plane and go through all that hassle.

the reason why nobody is encouraging u to file with out meeting is because nobody wants to tell u go ahead and do something that is not going to work, u came here for advise u have received a lot of great advise its up to u what u do with it
