Hello,

I'm so happy that I found this place. Now I can post everything that will happen to me and my future wife. We can post together and hopefully get the encouragement that we really need.

Anywas, she wants to apply for a k1 fiancee visa for me with USCIS. We just need to know one thing before we start with this. I tried to apply for a visitor visa but was denied twice. And she doesn't want to leave the U.S. So, one requirement is missing here. We have never met. But we have been corresponding for 4 years now. We have sent photos and always talked on the phone. I just wanna know if it is at all possible to apply for the k1 visa with a reasonable explanation for the lack of that requirement. Is it at all possible to start?

Unless you have a very very very good reason, maybe religious reasons it is very doubtful you will be approved and will have wasted $455. I suggest you meet before even contemplating filing a petition.

It is NOT possible to petition for a fiance one has never met in person - it will be rejected and the fee will not be returned.

(This will occur in virtually every case - the only exception would be if you had not met for religious reasons - and forget about developing 'sudden religious reasons' because they know which circumstances this applies to.)

as far as i know you HAVE to have met at least once and if u live in a country that makes it pretty impossible for u to get a visitor visa she will have to go to you if u want to proceed with fiance visa

You will not be able to apply for a K1 visa unless you physically meet in person at least once. And you will need to save plane tickets to prove that you did meet. The one exception they make is for an arranged marriage, which yours sounds like it is not.

I don't know where you live or what her reason for not wanting to leave the US is. If it is a matter of the cost to fly to visit you, perhaps you can arrange a vacation together in a third country that is easier for her to reach and easier for you to get a visa for. If it is a matter of her not being able to take vacation time from work, at least try meeting in Mexico or Canada, which could be a long weekend trip for her.

It's also really not a bad idea to at least spend a little time together before committing yourselves to this process, relationship wise.

i know of one case on vj where they didn't meet in person, but that was due to being unable to fly for medical reasons.

Anyways, I think that meeting in a neutral country is the best thing to do. In that case, I will need to keep some photos for us and copies of our tickets maybe. Anything else?!!

Any other opinions, please.

I believe that meeting ur fiancee in person is TOP on the list of requirements as proof of on going relationship and yes, i agree with all the replies from other VJ members aswell.. I suggest you should both meet prior filing a petition.

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:

Use as many of these items are possible. There is no minimum,

but the more you can provide the less likely you are that you will receive an RFE.

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.

2. Color Photo's of you and your fiance(e) together.

3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)....

no one encourage you because it is one of the requirements at the first step, USCIS won't approrve you unless you have an extremely good reason to do so. having been denied a VISA is not a good reason. Your fiancee the United States Citizen should come see you if you are not able to go see her. If she doesn't want too then.... :blink: There are good guides here on this site, you can have a look to check out the rest of the requirements..

This is not about opinion, this is about fact.

They will NOT approve your petition unless you have met in person, case closed.

Do you think they will just waive it because your fiance doesn't want to get on a plane?

If they were that lax with the rules, people wouldn't have to fight this hard to be together.

The only way you'll get approved without meeting is if you have signed documentation from a doctor stating there is a medical reason as to why she can't get on a plane or, some religious documentation that states it's against your beliefs to meet before marriage.

That's it...end of story.

I'm not meaning to be blunt, but that's the reality of this situation.

Get her to swallow her fear or whatever it is, get on a plane and file the papers after the meeting.

We're only trying to help and give you the straight answer. I don't think anyone wants to encourage you to do something (like petition for a fiancé) that will end up in almost certain rejection.

You can say what you want but if you're not free to marry and have met in person (within the past two years) it is not worth throwing away the money and time. Is it?

Best to figure out a way to meet in person. :thumbs:

This is very good advice. What VJ'ers are trying to do is encourage you to meet. And have proof of a relationship. Going through the guides will help you a lot.

The other thing...and this I believe is important. Is to count the cost. If you fiancee isn't travelling because of lack of $$$, then how are you going to pay for a K-1, AOS, removing conditions, and possible naturalization? Plus the affidavit of support? We are not trying to discourage you at all, but help you to make sure all is in place with no problems. Tim and I didn't quite dig into this far enough, and there may be a factor that could deny the visa. Thankfully we have time to search it out, and hopefully get things in order before the interview.

Tickets and photos are good; even better if there are other people in the photos with you (family, friends), though I suppose that is unlikely when you are meeting in a third country. Hotel bills naming both of you would be good too.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
