overstay on student visa

I have a friend that is about to marry a man from russia. They have been dating abotu two years now. He was here on a student Visa and overstayed.

Does anyone know how their VISA route will work?

I get really frustrated about illegal immigrants after the mess I have been through, but she is still my friend, so I promised to get any information I could.

depends on the length of the overstay.... a waiver may be required. The need for a waiver will be determined by the consulate at the time of interview

a VISA route may not be the best way.... a path directly to greencard (I-130 & I-485) maybe the best option as it would not require a trip home....

Hi,

If she is a USC she can marry him even if he overstayed. It will be forgiven as long as the marriege is bona fide. The best way is to file I-130 concurrently with I-485, in that case he would be able to stay in the USA while USCIS will adjust his status.
