k3: PROBLEM WITH 156 & 156K

Hi,

I face some problem while filling up 156 and 156k form.

26. How long do u intend to stay in US? I answered: 1 year

Answer: what it should be?

27. What is the purpose of ur trip? I answered: Family Reunion

Answer: what it should be?

32. Do u intend to work in US? I answered: NO (inspite of the fact that I know I will)

33. Do u intend to study in US? I answered: NO (inspite of the fact that I know I will)

36. Has anyone ever filed an immigrant visa petition on ur behalf? I answered: YES (Husband)

Answer: what it should be?

4. I provide my spouse and marriage date but in the short not, if I am already married in that case I am not eligible for issuance of Non-Immigrant Fiance visa...

what should I do in this case?

I'm not sure I understand the questions but when you fill out a DS-156 in connection with a K3 visa, your intention is to remain in the USA and become a Legal Permanent Resident, so your answers would reflect that intention. You can indicate you intend to work once you have authorization or simply indicate "undecided". I suspect you won't fill out the I-157k but any part that would apply only to a fiancee would be answered N/A, K3 visa or "already married" etc.

Facts are cheap...knowing how to use them is precious...

March 9,2010- Hard copy received

March 12, 2010- I-485 receipt notice for interview

March 18,2010- received letter for initial interview

April 19, 2010- 8 :15 A.M INTERVIEW DATE ( APPROVED 5min.Interview)

APRIL 20, 2010- USCIS website updated card production ordered

This is what I got from NVC website, and Bangladesh embassy has no information about k3 visa packet....

Applying for a Visa

The embassy or consulate where you, the spouse of an American citizen, will apply for a K-3 visa must be in the country where your marriage took place. Here are the procedures to apply. The embassy or consulate will let you know any additional things to do, such as where you need to go for the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a Consular Officer. The following is required:

Two copies of form DS-156, Nonimmigrant Visa Application

One DS-156K, Nonimmigrant Fiancé(e) Visa Application form

Police certificates from all places lived in since the age of 16

Birth certificates

Marriage certificate for spouse

Death and divorce certificates from any previous spouses

Medical examination (except vaccinations)

A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States (unless country-specific agreements provide exemptions).

Two nonimmigrant visa photos, two inches/50 X 50 mm square, showing full face, against a light background)

Proof of financial support (Form I-134 Affidavit of Support may be requested.)

Payment of fees, as explained below

So, for us is it the form DS-157?

In Manila Embassy website we dont need DS 156k. I only printed DS 156 and DS 157. I guess it depends on the US Embassy requirements in your country.

So, for us is it the form DS-157?

In Manila Embassy website we dont need DS 156k. I only printed DS 156 and DS 157. I guess it depends on the US Embassy requirements in your country.

So, for us is it the form DS-157?

Regardless of which forms are required by any given Consulate, a K3 applican't intention is to immigrate, work is allowed only after receiving authorization and any references to a "fiance(e)" would be noted that they are for a spouse or N/A as applicable.
