no taxes for 2009

hello my fiance and I would like to start the K-1 visa process.... but I have a few questions...

1) He quit his job in Nov 2008 and since about mid dec has just been helping out his friend, as he owns a business. He has not been getting any pay stubs because he is just getting paid cash. This is just a temporary job until he finds something permanent.

2) If he does not have pay stubs for 2009 will this affect anything?

3) Since he is unable to show he makes the poverty line, we have a sponsor lined up, will this be okay? or does he still have to show some sort of income?

please help

he should pay tax regardless, his former company will still send him his W2, he should try to get a legit job ASAP if not then you need a co-sponsor..

yes, he will get a W2 for 2008 and file taxes for 2008, but 2009 is the year I am worried about.

he doesn't need to do 2009 tax until April 2010, he has more then 1 year to find a job....

okay... soo if we start filing in the next 2 months, it will be okay to show the tax returns from 2008 and hopefully he gets a job and will be able to file taxes for 2009.

but he did not make enough to reach the poverty line, so we will need a sponsor correct? and both will need to fill out the correct forms?

if you are planning to file in the next two months you most likely wont need 2009 tax returns. as long as your interview is before April 15, 2010, you will only need 2008.

We are getting ready for the interview right now, and are NOT using 2008 tax returns, as they are not required until interviews after April 15.

He needs to make at least 125%* above the poverty line, not just to the poverty line.

I was a volunteer for the majority of 2007, so I only earned about 2000$ for the year, and although I have been working full time since Jan 2008, I am using a co-sponsor to avoid problems.
