My husband and i have been together in the US since feb last year, we are planning on applying for Green Card and the Work Permit.As far as i have seen on visajourney everything is fine and we can apply for those. My first question is is there anything else that we need to apply for, other than the Green Card and Work permit which as far as i understand are around 1100$ for both?

Our second big problem is that i have won a trip to Hawaii and we plan on going but we just cant stop thinking about the fact that IT COULD be possible for the guys at the airport to start something up and send him out of the US. Both his I-94 and ID are expired, we are no leaving Hawaii at all thus staying on US ground for the entire trip. Can we still go on this trip? Can he fly to Hawaii using his Passport? Has anyone had this issue before?

I know that all these questions might have been asked before but please for our own sanity we are asking them just to feel much safer.

Also, where exactly do i need to mail all the files for Work Permit, Green Card and whatever it is that its left to do? We live in Carson City, Nevada.

I must admit I am a little confused. You said your husband came here last february on a K1. Your getting pretty late for filing for adjustment of status aren't you? I have also read about others who didnt file the paperwork immediately but it seems like your kinda pushing the envelope lol. I would definitely check into the details, I know your husband may be accumulating illegal time within the united states and I think there is some significance to 180 days of illegal time. Hawaii is a state so I dont believe you have to pass customs, but the whole thing seems strange to me. I think we need more info to answer your questions.

Did you get married within the 90 days of his arrival? If so, then you just need to file the I-485 and the I-765 (Work permit). The fee is $1050. If you didn't get married within the 90 days then you also need to file the I-130 petition and pay it's fee. Since your husband has accrued more than 6 months of out of status time (since the I-94 expired) there is no point in applying for the I-131 (Advance Parole) as he cannot use it. If he leaves the country without the green card he will be denied re-entry and incur a ban due to out of status time). Download the forms and follow the instructions as to what to include and where to send everything.

Congratulations on your trip to Hawaii. Travelling to Hawaii is considered domestic travel so there is no problem with him going to Hawaii. He will need to have valid photo ID however, to board the plane so you will need to have that. His passport should be fine. They won't be checking his immigration status, just his identity. Once you file the AOS package and have the NOA receipt he will be back in status as well. Carry a copy of the receipt with you just in case anyone questions. You should be fine.

So, file the AOS as soon as you can for your own necessity and to protect your husband's presence in the US, and enjoy your holiday in Hawaii.

Yes we did get married within 90 days of his arrival.My husband has been worried for the past few weeks actually and i just started awhile ago when he told me, thank you so much for clarifying this for us, yes we have all the papers now for AOS and Work Permit we're going to send them this week most likely. Thank you very much for the help and advice about the travel and the papers, we were actually thinking a few days ago about not going to hawaii, would've been sad but made us feel much safer.Did the I-94 expire with the visa or with the 90 days agreement?Once again thank you so much.
