Form I-131 Advance Parole Questions

Timeline

Hello,

My fiancee will arrive here in the U.S. this Friday, June 16th. We will marry in August. We would like to return to her home country, Thailand, in November and have a Thai wedding for her family.

This situation would be Advanced Parole, correct?

Can we file only the I-131 form without AOS ?

Is this sufficient reason for AP?

If we are married and file the I-485 for AOS, according to the I-131 istructions, it is no longer considered AP.

What is it, if not AP?

12-22-05 I-129F mailed to CSC

12-27-05 USCIS receives I-129f

01-03-06 NOA1 by mail

03-14-06 NOA2 Case Approved

03-21-06 NVC sent case to BKK

03-27-06 BKK Embassy email "no record of my case"

03-30-06 BKK Embassy confirms case by email

Timeline

My advice: WAIT until you get the AP before making any travel plans! It takes 60 to 90 days after filing, and even then you're not sure to be approved! And AOS takes longer, much longer...

There are some stories on VJ about people having to cancel their wedding, ie., because they didn't got the necessary documents in time...

Do not make any plans, we didnt recieve AP until like 115 days..it was 3.5 months. Anything can happen. We wanted to do somet things and had to make changes because we did not receive the documents. If she is arriving this friday why are you waiting until August to get married? If you want to speed up the process, why not go get married at the JP, and if you are planning some kind of a formalised ceremony here, you can do that as well, but it will already be legal. You don't even have to tell anyone,,,just the person officiating your ceremony in Aug. That would buy you an extra 2 months of AP and you could probably make more concrete plans.

22 JUL 2006......AOS and EAD (?) touched...moving along maybe? :)

21 AUG 2006....Recieved interview letter!

26 SEP 2006.....INTERVIEW!!!!!!!!!!!!

26 SEP 2006.....APPROVED WITH FLYING COLORS!

05 OCT 2006....Welcome letter recieved

11 OCT 2006....THE CARD ARRIVES!!!!!!!!!!

15 SEP 2008.....Sent for removal of conditions

24 SEP 2008.....NOA for removal of conditions

10 MAR 2009....Transferred from VSC to CSC

22 MAY 2009.....REMOVAL OF CONDITIONS APPROVED!!!!!! :) Citizenship here we come!

Thanks for your replies. We have not, and will not make any concret plans for travel to Thailand, but this is what we would like to do.....if possible.

Can anyone answer my specific questions?

Will this reason qualify for AP?

Can I file the form I-131 alone?

If we are married and file for AOS (we do not have to wait for approval), the I-131 instructions state that under these conditions, this is no longer AP? What is it then?

Yes, but not before adjustment of status has been applied for - it is the pending AOS that qualifies a K1 for advance parole.

You have to include a copy of your NOA1 of your AOS along with the AP request. You have to be a pending adjustment person in order to apply for AP. You can submit the AP petition along with the I485.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Thanks. I misread the I-131 instructions.

You have to include a copy of your NOA1 of your AOS along with the AP request. You have to be a pending adjustment person in order to apply for AP. You can submit the AP petition along with the I485.
