Hello

I am not 100% sure how we need to for a US citizenship for a child born in Canada. I am currently 28 weeks pregnant with my first. My boyfriend is a US born citizen, some may remember me from my above posts. I am applying for a Fiance Visa to gain my US Citizenship. I will be giving birth in Canada, and she will acquire US citizenship at birth. What is the process to obtaining that citizenship including passport and everything. I was told I need to fill out a Consular Report of Birth by someone here? is that true? or do I just go to the US embasy here to register her birth? also what will she receive after?

First of all, by receiving a fiancee visa you do not gain U.S. citizenship but you receive a visa which enables you to enter the U.S. with the intention to get married and apply for AOS afterwards. You won't be eligible to become a citizen for at least three years after you have become a permanent resident.

I will be giving birth in Canada, and she will acquire US citizenship at birth. What is the process to obtaining that citizenship including passport and everything. I was told I need to fill out a Consular Report of Birth by someone here? is that true? or do I just go to the US embasy here to register her birth? also what will she receive after?

I assume you will not get married before your child will be born. That makes things a little more complicated in obtaining a Consular Report of Birth Abroad. My guess is that your fiance will have to sign a sworn affadavit in which he confirms that he is the father of your child. But it would be best to contact the U.S. Consulate directly to receive information about this matter:

With your Consular Report of Birth Abroad you also can apply for a SSN and U.S. passport for your little one.

No were not getting married before she's born. We haven't yet filed the K-1 Petition.

Yea I read, he just has to proof he is the father which isnt complicated. Just one extra step, so once we file and go through all the steps does she get a US birth certificate stating she was born aboard?

Yes, she receives a Consular Report of Birth Abroad. This is proof of her US citizenship.

We just went through reporting our daughters birth abroad. We were in a little different situation because we are married. You need to contact your nearest consulate. Vancouver allowed us to book our appointment online. The US Citizen has to be present. You can apply for your childs report of citizenship abroad, passport and ssn all at the same time.

They ask for proof of the US citizen's presence in the United states. So he will need a written letter from his employer's etc for the past 5 years. It has to be an original not a photocopy. Otherwise just the usual forms, birth certificates, id. I know they state they can ask for more than the regular stuff so please be sure to have proof of his being the father... written affidavit or something.

It was fairly simple. Take a medium sized prepaid express post envelope with you so they can mail it back.

If you file for your K1 visa just maybe include a letter from your doctor stating your gestation dates etc.... it helps as proof of relationship.
