Lady getting married, will travel. Helps!

My fiance and I have been engaged for some time now. He's an american, I'm a Canadian...yada yada same old story.

My brain doesn't wrap well around jargon, and I've looked through the guides and so on for the last couple hours because that is what I do.

I'm going down there for an extended visit (April through August) so that we might plan our wedding and get to it. After that I return to canada and we apply for CR1.

We had originally planned on the K1, but restraints being what they are I decided to take my father's advice. Visit for a few months, come back to canada for a while, rinse, repeat.

My big question is this:

Can I marry him in the states, come back to canada and submit this crazyness or do we have to get married up here?

Seems a bit noobish, but here I am asking anyway.

yes, u can goto the USA, get married, start the paperwork then come back to canada. Thst what some here on VJ, including myself have done. On one of my 4 day trips, we got married, I returned to Canada and soon after submitted the paperwork. If ur down in the USA for a lengthy time, start the paperwork right away, as long as someone can check ur Cdn mail!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Just be careful that when you travel to the US to get married that you don't have any of the frillies with you, otherwise they may deny your entry because they'll suspect you'll be staying illegally. If you plan to be wearing a frilly gown for the ceremony, buy it down there after you arrive.

I did the same thing - except only spent three weeks there. I carried my dress with me on the plane. They asked for proof of ties to Canada - I had a letter from my employer stating I would be returning and had a copy of my return ticket. Also my daughter did not travel with me she came down later and left before I left. It all worked out. Just be prepared to spend some time being questioned.

If you entered the country and didn't plan on getting married you are fine. Things happen like love and marriage.

BUT....if you enter the states planning to get married without a K-1 visa then you are here illegally and it is visa fraud. Even if you make it past the border if the consulate finds out the truth during the CR-1 you are in trouble. The fact you are intending to marry here without a K-1 will make them look that direction. So be ready to prove this was a spur of the moment thing.

The number one thing when immigrating is don't lie. It is much safer for you to marry in your country and then come over on a CR-1 or get a K-1 visa. Congratulations to you both BTW. -J

Not the way they are doing it. Its only a problem if there is intent to stay without going through the proper channels, but getting married and coming back to file the paperwork is completely legal.

in this situation they don't need a K1 visa to get married in the US..

Yeap, if the plan is to get married, and then return to home country, there is NO FRAUD whatsoever, and this option is perfectly legal. I did it myself and the interviewer at the consulate didn't even bat an eyelash about it.
