Hi,

I am getting my packet 3 ready and I was wondering if I have enough evidence for the affidavit of support

I have:

- letter from my fiance's employer, stating his job title, when he started, and how much he makes per show and how many shows there will be this year. ( + the fact the the employer pays for lodging, food and health insurance)

- a letter from his employer stating how much he made in 2008

He makes more than enough money for the both of us, so I'm thinking this should be enough evidence... But I am not 100% sure.

Do I need bank statements? Or his tax returns? Anything else?

Thank you so much for your help!!

In this instance, he needs to provide the most recent tax return in addition to the other evidence you already described.

Also, he will need to meet or exceed the poverty line of income, as described below:

2008 Poverty Guidelines for the 48 Contiguous States and the District of

Columbia

------------------------------------------------------------------------

Poverty

Persons in family guideline

------------------------------------------------------------------------

1............................................................ $10,400

2............................................................ 14,000

3............................................................ 17,600

4............................................................ 21,200

5............................................................ 24,800

6............................................................ 28,400

7............................................................ 32,000

8............................................................ 35,600

------------------------------------------------------------------------

For families with more than 8 persons, add $3,600 for each

Where do I get his tax return? Can I ask his employer ( they did it for him)? Does he need to be in the States for that?

Thanks a lot!

Well, individual tax returns are generally filed by the taxpayer. In this instance, his employer should have provided him a copy. Ask the employer to provide a copy, if you don't already have one.

No, he does not need to be in the USA for this.

I don't know how it is for the K-1 but on my appointment letter it says:

A completed Affidavit of Support (Form I-864) with all required evidence, icluding the following, for each of your sponsors:

- Federal Income Tax returns and W2's, or certified IRS printouts, for the most recent tax year;

- Letters from current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 month

- Evidence of your sponsor's United States Citizenship or Lawful Permanent Resident status

ROC - approved 08/2011

Ok I'll ask his employer cause he doesn't have a copy.

Thank you.
