outside of processing times question?

I live in Southern California. My wife applied for her I-131 over 3 months ago. Besides a notice of the application being recieved we've heard nothing else. I've tried to call the USCIS but they wouldn't give me any information on the case since my wife was unavailable. Currently she is outside of the country (I know I know) helping her family. She will return in July, but we are both weary of crossing the US boarder without her travel document. Is there anything I can do without her to gain any information. Do I just wait it out, and expect that the documents will arrive soon? Even though she is outside the country she is still unable to call the USCIS herself. Where she is there is no cell phone service, or access to any other kind of phone.

Since she's already outside the country you already know that it's a worthless document to you, right? You should think about calling a lawyer and discussing this in private.

How is she crossing the border without an AP document? You know she can be denied entry? Well anyways, we did an inquiry on my husband's AP when the date at the MSC was 30 days from our filing. Our NOA1 was Feb 15, and one day the MSC reflected they were processing MAR 16 petitions and we called and they said they did an inquiry. We never got any info, etc and when my husband went for the EAD interim on June 2, we asked about the AP and the girl said she would inquire because it had been too long. That next monday we recieved an approval email and had the document last friday. Hope that helps, but the document could be considered null and void, and your wife abandoning the petition if immigration catches this.

14 JUN 2006.....regular EAD recieved in mail

22 JUL 2006......AOS and EAD (?) touched...moving along maybe? :)

21 AUG 2006....Recieved interview letter!

26 SEP 2006.....INTERVIEW!!!!!!!!!!!!

26 SEP 2006.....APPROVED WITH FLYING COLORS!

05 OCT 2006....Welcome letter recieved

11 OCT 2006....THE CARD ARRIVES!!!!!!!!!!

15 SEP 2008.....Sent for removal of conditions

24 SEP 2008.....NOA for removal of conditions

10 MAR 2009....Transferred from VSC to CSC

22 MAY 2009.....REMOVAL OF CONDITIONS APPROVED!!!!!! :) Citizenship here we come!

As meauxna was hinting around... The I-512 Advanced Parole document is worthless as your spouse left the US before it was issued. You r spouse is now inadmissible as she has abandoned her AOS petition.

Sorry, but you're going to have to file an I-130 for her to be able to get here now...

OOh, Z, I'm glad you stopped by. I didn't want to be so definite, wondering if there was some Canadian border weasel thingie that might be possible (ala K-1 pre-entry). But, say they do do that, wouldn't it come up at the AOS interview, and what would happen then?

She left the US without AP, the AOS application has been abandoned. If she left by land, it would be somewhat difficult to determine when exactly she left. If she left by plane, it's questionable regarding the date that she left as most people aren't looking to take I-94's from Canadians. But if Canada stamped her passport, that's all the evidence they will need...

Could the OP's spouse slip under the radar.. it's definitely possible. Canadians are the only people who possibly could (until December 2007 that is). But the CBP officer will usually ask how long they've been gone. If the date she left and the date the AP was issued don't jive... She'd be sent back like a young Malaysian did in Detroit a couple of months ago...

If she somehow made it through and did make it to sitting in front of the adjudicator, I'm sure there would be some questions regarding her entry such as How did you get into the US without misrepresenting yourself in some way... (i.e. produced a BC and DL to get in instead of a passport or didn't divolge the truth in how long you've been gone). If you misrepresent yourself.. it's all over... removal hearings, deportation orders.. etc.

Lots of questions with very likely bad answers...

The only good answer is to file the I-130. This is a case where the couples needs didn't jive with the requirements for a K1 and now they're going to pay for it...
