Hi,

I've been reading everywhere about getting my friends affidavit about knowing us and seeing us together.

I see different explanations.

Some say these affidavits don't need to be notarized and some say they do.

What's the rule as of 2009?

Be sure to print out a copy of silly girls famous ST. Lukes step by step story.... Its fantastic and made it incredibly easy for my wife to go through the 2 day procedure. I will go find it and put a link.... here it is:

Actually it depends upon the form and the version. For example the pre-Oct 2008 I-134 needs to be notarized. The Oct 2008 version does not need to be notarized. As always the guides are guide but always download the latest required form from USCIS.

As far as I know - there are no 'rules' in regards to this subject. If it were me, I'd get the statements notarized - the fact that they were notarized gives them more weight (IMO). Again - if it were me, and I needed statements from my friends/family - I'd want every advantage I could get. :thumbs:

You don't need affidavits if you have enough financial evidence. I just got approval without them

:thumbs: Exactly right! You don't really need an affidavit. If you read carefully, they give you a list and they say to choose a certain number of things on the list (actually I'm not even sure they say how many to choose, I just know they have a list and it is up to you which you decide to give to them. It might say something like choose 5 out of 7 on the list. It is obvious I forget and obvious I'm too lazy to look, but I know an affidavit isn't a must).

If you think your other evidence is good enough then forget the affidavit(s).

Having something Notarized only confirms that the person signed it in front of a Notary, who has seen ID to confirm that the person signing it is who they say they are. It does NOT confirm the content of the letter.

Affidavits are the weakest evidence and does not carry much weight. If you are lacking on evidence it may help or may not. It would be much better to submit more financial evidence and leave out the affidavits.

I submitted my I-751 Jan.2008 with Notarized Affidavits from friends and family and still got an RFE. When I re-submitted i still sent updated notarized affidavit with the same people, I got approved but as co-VJ'ers said with or without affidavits it can still be approved but to be safe might as well submit whatever you can to satisfy USCIS. The more evidence the more you won't get an RFE/Denial.

May 9, 2005 - Arrived in the US

Jun. 18, 2005 - Got Married

Jul. 28, 2005 - AOS and EAD submitted

Aug. 3, 2005 - INS receipt

Aug. 7, 2005 - Received NOA 1

Nov. 16,2005 - AOS Biometrics

Jan. 23, 2006 - AOS Interview (Approved with stamped passport)

Jan. 25, 2006 - E-mail confirmation from USCIS (application approved)

Jan. 27, 2006 - Received the Welcome to America Notice

Feb. 1, 2006 - E-mail Notice from USCIS to send Green Card (Yipeeee)

Feb. 3, 2006 - Received my Green Card (Two Year GC....Woohoo)

Jan. 23,2008 - File for Removal of Conditional Status

Jan. 30,2008 - Received NOA 1

Feb. 23, 2008 - Biometrics

Dec. 6, 2008 - Received RFE paper

Dec. 18, 2008 - Submitted documents thru Postal Mail.

Jan. 6, 2009 - Card Production Ordered (Yipee....light at the end of the tunnel!!!!)

Jan. 12, 2009 - 10 Year Greencard Received (Thank God!)
