Timeline

I am married to a Colombian woman. She came to the USA in April of 2007 from Medellin on a fiancé visa. We were married in May 2007. Things have been up and down. Not great not bad. Normal marriage issues.

Anyway, I just found out that she has been keeping on with her ex-boyfriend. I overheard a conversation while she was in the bathroom (she did not know I just got home) the conversation contained a lot of soft talking with the words “Amor” and ”corozon” ….

When I confronted her, she said that it was a friend and that it that it is not unusual to talk like that to her male friends from Colombia. I let it go, as I did not want to provoke a major argument. We have a little girl in the house (hers-not mine and not from the boyfriend)

Anyway, I investigated a little more and while I checked her phone messages, sure enough there was a saved message from the “Friend” from Colombia. It was obviously from someone more than a friend since it ended in “Te quiero mucho”.

I just found this out on Thursday. I am trying to figure out what to do. I am planning to apply to remove the restrictions on her conditional resident card next month

(it expires this year) but it seems that she is not true to me and probably will leave me in the future.

I figure have three options 1. accept it and try to build a better relationship, 2. Divorce and let her apply on her own Or 3. to completely try to screw her make and it difficult and expensive for her to lift the restrictions. Any comments will help. Thanks

Wow! I'm so sorry for what you are going through. I'd say that no matter what you do, you'll have to confront her before you do it. Ultimately, life is short and it isn't worth living in misery. Me personally, I wouldn't offer any more assistance, I would just cut my losses and move on with as little as possible emotion or drama.

Lastly, if she is already being dishonest, it's likely to be part of her character. I believe that most good or bad things people do TO or FOR you are not based on anything you do, but based on who THEY are. It's not personal.

I-129 submitted on 5/26/06 (on OLD forms because the new ones weren't out!!)

Nothing else has happened after that as far as I know... No RFE's, Nothing?

Email notice on 9/11/2006 that my question would be answered.

Email notice on 9/12/2006 that the RFE is in the mail 3 months after my WAC number

Next trip to see her for a week on 9/23/06...

Went to Colombia on 9/23 returned on 10/1

I never received my RFE but my attorney sent me his copy which I filled out and overnighted on 10/3 RFE delivery confirmation on 10/4 but nothing from CSC yet...

CSC Email saying they have my RFE on 10/11/06, a full week after they got it.

Note that to this day, I've still NEVER received my copy of the RFE they said they mailed to me! I've seen lots of posts about lost RFE's and other documents from the CSC! This concerns me greatly!

NOA 2 on 10/18/2006 Woo Hoo! 129 days from NOA 1.

Yesenia arrived in the US on January 18th, 2007

We were married on 3/17/07

Filed for Green Card and Employment Authorization right away.

Green Card was issued (with EAD card) on 6/15/07

We'll be filing for AOS pretty soon.

If it truly is her ex-boyfriend, then the marriage was not entered into fraudulently. Screw that ######. No more green card. Hello Colombia. Will she want to get him to America after she is a LPR. Probably

Sorry to hear that Soccerman45, I please don't believe that "corazon" or "amor" in a normal things between friends! I will go with your option #2. The 3rd one is very complicated unless you have a lot of proof that she was with you only for the green card OR if you have proof that she was not loyal with you marriage.

i'm truely sorry to hear that soccerman, what i would do in your case, I wouldnt lift her conditional residence and get divorce if you are sure she's still keeping in touch with her old ex-boyfriend. She would probably ended up being denial and be deported. Move on and good luck to you.

She can't apply on her own if she is still married to you. Petition is called JOINT PETITION TO REMOVE CONDITIONS...

I'm very sorry to hear that, and like many others, I'd divorce her and not help her lift conditions. It does not sound like she was honest with you about the phone calls, and I am the type of person who would then call the entire validity of the marriage into question over a lie like that. But that's me, and I admittedly do have a short temper.
