Hello everyone,

I just filed my I-129f. My fiance is seriously considering quitting her job as a receptionist @ a hotel in Pattaya and moving back to her parents' village near Udon Thani to open up a drink and snack shop at or near her parents' home. She feels it would be nice to be closer to her family before she leaves for the U.S., and it is much cheaper to live in her village vs Pattaya. I have a few questions:

1.) Will quitting her job and becoming self-employed (possibly not employed at first, until the shop is setup) have any negative effect on our attempt to get a K1 visa?

2.) Do we need to notify USCIS about this change in employment if she takes this route? If so, how?

3.) Do we need to notify USCIS about this change in residence if she takes this route? If so, how?

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

It won't matter that she quit her job, and you won't need to notify USCIS about it.

The change in residence can easily be corrected. You have a few options, but I'd contact the Department of State visa department first. Ultimately, the embassy will need the right address to mail out the "packet 3"

Apr 28, 2008 -------> Filed (forms mailed)

Apr 30, 2008 -------> Forms received by USCIS

May 06, 2008 -------> Cashed check posted to account

May 10, 2008 -------> NOA1 received for EAD, AP, and AoS

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

Jul 14, 2008 -------> EAD and AP received

Jul 17, 2008 -------> AoS approved (card production ordered)

1) NO :no: USCIS, NVC, and Consulate are NOT concerned with foreign citizen's employment status, they are concerned with US Citizen's income status, hence the I-134 for the visa interview.

2) NO :no: USCIS does not need to be notified of either person's employment status.

3) NO :no: USCIS does not need to be informed. Later when it reaches NVC inform NVC or DOS or Consulate of address chnage so that they can send the packages to the correct address.

Once you receive your NOA#2 from the USCIS, stating your petition is approved, then your fiancee can get the whole packet online and see what she needs to do for her interview. Check out the website for the embassy she will be applying for her K-1 Visa at.

We did an address change with the US Embassy in Bangkok. They were very responsive. If I remember right they sent out another packet three. We also got the info from their web page. Since apparently there can be discrepancies between the online and hard copy instructions, it's good to see what is actually in packet three.

When you email the embassy just make sure to follow their instructions to letter regarding the format. Make sure you put "change of address" in the subject line along with the case number. At first I tried to change the address with the National Visa Center, but they had already forwarded the petition to Bangkok.

The employment is a non-issue.
