Hey

My I130 application was just sent from the Vermont Service Center to the California Service Center. At the CSC the processing time is 6 months from now. Does that mean that at the end of the 6 months they will contact me or does that mean that over the next 6 months I will find out whether my husband will be able to leave Jamaica and come and live with me in NYC? If anyone has any experience, please let me know. I need to know if it is wise to purchase my tickets to stay in Jamaica for the summer (6 months will end in July). Again, any info would be greatly appreciated.

You are NOT doing a fiancee visa so will move this from the K-1 forum to CR-1 forum since you only mention I-130.

The 6 months has to do with the oldest cases being looked at by CSC, this has to do with filing date, not transfer date.

Note: husband wont be able to immigrate to use until after interviewing for the, not after USCIS approves the I-130, you will still be dealing with NVC and the consulate for a visa.

So I should go ahead with my plans of spending the summer in Jamaica? How long did it take u? R we in the same position? I know of no one else that is going thru this so I have to join forums like this for help. I chose not to get a lawyer so we r pretty much flying alone. How long before we can actually be under the same roof? What will the next step be? Again, any info is graciously appreciated and thank u to those who responded. We greatly appreciate it. We knew that this would take some time and we are definitely going to see it thru. In the meantime, I spend all of my time off in Jamaica, so I just don't want to miss any important updates.

Thanx, again, in advance and I will get him being here in 6 months or so, out of my head...thanx for the wake-up call.

Yes it gets this thread moved to the K-3 forum.

Not much changes, the K-3 may save you a month or so, is all.

If you wish to immediately take a Job after entry to the USA, the K-Visa is NOT the way to go.

If considering K-3 think carefully about it. CR-1 and K-3 tend to take about the same time, K-3 may save you about a month, however the K-3 has the added pain of adjustment of status, and it NOT a work authorized visa, so also has the added period of limbo waiting for EAD to be able to do things like take a job, get SSN, etc...

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

If you consider CR-1, all you need to do is keep the NVC processing going for CR-1, and delay responding to the K-3 Packets from consulate, or reschedule K-3 interview to allow the CR-1 to complete at NVC and get sent to the consulate.

I think it's safe to go ahead with ur plans. Well, we got married May of 05 didn't file until April 06, for approved August 06, case was complete by January 07, interview July 07 hubby came home August 07. It was pretty straight forward until the case was transfered I was in limbo for a minute. By the time his passport got stamped we were already married 2yrs, so when he got to the POE JFK they changed his visa from CR1 to IR1 which gave him a 10yr GC instead of a 2yr conditional GC. He was able to work right away. SS card came in the mail and so did the GC.

I believe NVC is now scheduling interviews for CR1 visa

we ddn't use a lwyer either

as YuandDan stated, if u want him to work soon after getting here CR1 is the route. the K-visas u have to wait to get married then file papers for EAD etc.
