Hello,

I want to send the affidavit of support to my fiancé now. We have not received NOA2 yet, but I want to send the affidavit now so when NOA2 comes and he receives pocket #3, he has everything and can send it out immediately.

My concern is this, do I have to wait to send the affidavit until he receives the pocket? I don't know if there's some kind of time frame or if they see the affidavit they will tell him he needs a new one that's with a more recent date.

Please give me some sort of advice.

if your interview date is after January 30th, you will have to show 2008 tax return at the interview, there are other things you will need to send as well, like updated proof of your relationship, bank letter, employment letter, etc..., it would be wise to wait until you have an interview date

WHOA! Hold on there Nelly! Nothing wrong with getting the packet 3 ready, but the I-134 is bst produced as closely to the interview as possible, within reason. Do you actually have to send documents to the Albanian embassy? We did not in Ukraine, we only "said" we had them ready and then brought them to the interview. If you must snd them, then wait until you get your NOA2 and THEN get the I-134 ready. It will take about 3 weeks for the approved visa to get to Albania and get in their system (minimum, IF it isn't held up at NVC) and you can take that time to get your employment letter, bank letter, etc.

Also check if you need to send these documents prior to your interview (to the consulate) in most countries you do not, you bring them with you. In the instruction letter from Kiev it says very big at the top "DO NOT SND DOCUMENTS TO TH CONSULATE" Also some only require you fill out, sign and send the checklist, not all the documents. Be sure of this, because if they do not want you to snd thm, and you do, you could be in for a big surprise when you get to the interview.

Good advice but what is sent to the Embassy or Consulate is not an approved visa. It's an approved petition. Visas are approved and affixed to passports AFTER the visa interview.

At this date, with no NOA2 in hand, I'd wait until at least early February, to complete the I-134, so the 2008 tax return (complete with W2's, 1099's etc.) can be included.

Facts are cheap...knowing how to use them is precious...

yeah my fiance has to send all of that stuff along with pocket 3

I stand corrected and it is a "typo", or confusion of terms, I frequently make (along with sometimes referring to the consulate as "the embassy"). It is correct, the consulate gets the approved petition and then you file an application to issue a visa (DS-156 in the case of the K-1).

Are you sure about this? I thought that you only needed to provide 2008 tax returns if your interview date was after April 15th, 2009, since that is when taxes are due.

If someone could provide correct, matter of fact (not just hearsay) info about this, that would be greatly appreciated.
